I was called by this company and threatened to be arrested if I didn't pay at least 1/2 of the amount within 48 hours. Can they do this? I also requested that they send this info to me in writing and they said they weren't required to is that true


She told me claims that she did. I told her that if I had received anything that I would have called on something this serious. The first contact I had was yesterday and was given until noon Friday. She wouldn't even give me the western union information until I tell her for sure that I would send the money.I told her that I wanted it in writing so I could be sure that once I paid this company the original payday loan company wouldn't also try and collect the money.

kdenboer, don't send your personal information until you have everything in writing from the company. You need to make sure that the company doing the collections is a legitimate one. I wonder why the collector is not giving you the necessary information about the company for which they are collecting. You need to be suspicious while dealing with them.

I was called at work and threatened to be arrested if i didn't pay them 720 dollars by noon and that they would have to clear it with a judge for split payments and that if i didnt pay they would send an arresting officer to my job and arrest me

Stay strong. Bergen-Boesch is trying to intimidate you with their scary tactics. If they really can take the legal actions, the debt must be validated in writing at the first place. This will prove about their legitimate collections. If you haven't received anything from them, send a debt validation letter so that they are forced by fdcpa laws to honor your request.

Bergen Boesch contacted me as well threatening me with arrest - I filed a complaint with the houston BBB and the Federal Trade Commission and the Illin AG office of Financial & Professional Regulation - I believe Evan Webb wears many hats (receptionist, supervisor as I called there and they all sound the same). - DO NOT SEND ANY MONEY TO BERGEN BOESCH- they bought your collection account from the National Money Store 8)

I have had many phone calls from a woman named Anna Cline. I too have had the same intimating calls. I was told that I was going to be arrested and would have to go before a judge etc etc etc.
I finally asked for the spelling of her company name and she did give me that. Prior to this I went on line with Google,reverse phone to no avail.
I tried once more to put their name in with correct spelling and happened upon this web site.
I'm so glad that I did. Do I need to take anymore steps?

So I also got a call that I would be arrested if I didn't make payment by 12 noon. Well, I've been trying to call to get an address and haven't gotten a response when I called their office. What is going to happen? Are they going to arrest me? Please assist.

Eva, collectors use jail threats as the most common weapon. Be rest assured nothing will happen like that. If the company has a legal case, a civil case will be filed at the court and you will be set payments through court. Needless to say Bergen Boesch has to prove their genuine collections before getting a court date.

I received a call on Wednesday from Bergen and Boesch and was told that I needed to pay a debt by Friday noon or I would be arrested. I work at a school and surely can't have anything like this happen. I was told that I had to send $190.00. I don't have that amount. I have $140.00, should I send that - I am scared about this arrest thing. The lady was really trying to be nice saying that she was here to help me and not to hinder me. I am so glad that I looked up the company on the internet. I am a little skeptical however because I can't send the money by Quick Collect, I have to send it as a person would send money.

Ladinna - as the others has said - have you received debt validation from this company? If not, don't send them ONE PENNY until they send you something in writing.

Read the Fair Debt Collection Act:

Section 809

They have to validate the debt with you before they can do anything. Visit the letters section here:

And send them a debt validation request. Until you receive that, they have no legal right to arrest you. Jail and court are illegal action these criminal companies use to scare money out of you. If you owe it, make sure you make good on repayment. But do not be threatened into something you feel in unfair.
