He's probably trying to intimidate you. Call him back and ask which jurisdiction they intend to have issue the subpeona (so as you can be sure it's the right one). That usually will shut them up and get them talking more calmly. Dont' let them intimidate you. There are plenty of links, and additional information on how to deal with CA's all over this site. First, request they send you something in writing (which they legally have to do). Don't agree to any payment plans, or even accept responsibility for the debt with them until you recieve that letter.
Send back to them a request for validation of the debt certified mail return receipt request. They have to respond in 30 days (if they are legal they will). At which point you can begin whatever negotiations you want. Just don't let them intimidate you. You can't go to jail (seems to be the new trend). They can take you to court, but threatening to do so will usually only get them in trouble because they can't tell you they're going to sue you if they have no intention of doing so.

phonguy, thanks for such wonderful advices. You have a point. The fdcpa restricts collectors from making false threats. If legal actions are intended, the person will be notified about it before papers have been filed at the court. Making false legal threats to recover the money is strictly prohibited as per the FDCPA. I am sure the collectors are aware of it but they just want to get the money from the people in the easiest way and creating fear. Don't get intimidated. Use your legal rights to handle such collectors. Here is the link to the FDCPA
