Wage garnishment

I'm having a little problem with mycashtime.com. I took out a payday loan and was unable to pay it in full. I set up a payment plan and I have made two payments on the loan. I have advised them that I need to extend my payment plan over two more pay periods and they are telling me if I back out of our deal that they will garnish my wages. Can they do that?


They are an online lender and they are not going to garnish your wages. This is a common threat among the online lenders. They do this to intimidate and scare people. The most they can do, is send a wage assignment to your employer, which can be revoked by you. They would have to go to court to get the garnishment and I have never heard of an online lender going to court. They wouldn't dare step foot in a courtroom. Most of the online lenders are operating without a license in most states and charging outragous fees.

I can't say the lender will not do it if they have a legal stand and until your later extensions are accepted in writing. Since you are continuing with your payments as usual, things will sound better even if the matter is taken to the court and the judge reviews over it. Make sure that you don't miss those payments. The company cannot garnish your wages without a court order. They need to file a case against you at the court and must show some reason that you are avoiding this debt. If you can keep things in balance and show your payments regularly, you will place yourself in the better side. In the meantime, keep on negotiating with the company because they might accept your proposal sometime later and they know it very well that the case won't be strong enough against you.

Tammy is absolutely correct..They won't do it. they can not obtain a judgement..And consider the fact that it would probably cost them almost as much as the amount of your loan to get the judgement..TRUST ME. They are just trying to strong arm you.
They could send a wage assignment, though..They like to call wage assignments garnishments. If you do by chance get a wage assignment, please feel free to pm me, because I can help you through that.

I receive an email from PA State Attorney General and I had 2 issues address. First the apr a PDL place can charge is astronomical and the Dept. of Banking whom I spoke to today told me its hard for people to dispute the amount they charge as interest or to refinance a loan from paycheck to paycheck. Second issue was on wage garnishments and the information I receive was if any PDL place tries in any kind of way to garnish your wages, then get in touch with your SAG and file a complaint. It could be look at as unfair debt collection practices. From that info it looks like most likely any place that will garnish your wages cannot and will not step foot into a courtroom and will not garnish your wages. Get in touch with your SAG and get your ducks in a row. And make an agreement and keep to it.
