OK NCO called today and said I have 48 hours to pay 1800 to them or they will take me to court and then I will owe 6000.. I have baddddd credit .. I dont have 1800 I am barely makeing it now... my soon to be wife has no credit and cant get a loan for me what do I do?

Jeez!! NCO is a pain!!. This company has serious negative feedback everywhere. They were heavily penalized for their illegal debt collection practices in the past. It is published in the FTC website also. Read this one.

http://www.ftc.gov/opa/2004/05/ncogroup.htm

Now, since NCO has made an attempt to collect money from you this time, did they send you anything in writing covering the debt validation process? They are legally forced to give the complete details of the account before you make any payment. Read this rule if you are unaware about it.

http://www.ftc.gov/os/statutes/fdcpa/commentary.htm#809

If you send a request to validate the debt in writing, make sure that you send the letter through certified mail and cover your move legally. You will need to prove all your actions if the matter takes a legal shape.

I had to deal with them years ago, right after my divorce. My ex got his car repossessed and they expected me to pay for it even though I wasn't on the title. Anyway, they started calling my parents, brothers, co-workers even after I sent them a letter stating not to call these people. To them I was just a deadbeat not paying my bills. I eventually got a lawyer and took them to court and won $10K against them. It sure sounds like they hasn't learned. Don't put with them. Fight back!

Try dealing with the original creditor. If your account is not sold to NCO, they can work on your payment plans. Guess, that might be much easier. Remember to check the SOL of this debt account in the state where the account was opened. If the date of last payment is long time back. Don't show any payment until you have verified the debt status properly. A single payment can renew the SOL period from the beginning. However, if you are interested to pay off the account even after the statutes have expired, go ahead and make the deal. The result will be good for you slightly when someone will be viewing your file and seeing the account as paid.

Are these people really lawyers?. Can you be sued by these guys?. Seems like they are very aggravating.

They are not lawyers, though when they call my house looking for my ex-husband (of OVER 20 years), they say they are. When I called their number to ask how in the world my name would EVER come up and how they had really disrupted my household (my 12 yr old son never knew I was married before, now he's freaked) they started cussing at ME. A call back to a Supervisor had me on hold. I don't know what to do but I did find out they are NOT attys.
