Thanks,Guest,you may be right. About a month ago I get this letter saying my son owes 700 dollars from 2000 and 2001. This was supposed to be adjusted and written off according to his income,and wasn't.Now they say we are responsible for him even though he's over 21 since we claimed him on income tax. But guess they figured out they couldn't do that and turned it over to a CA. That debt may be too old for them to collect anyways. Do you have something to show it was supposed to be written off? If so, that is all you need. Just copy it and send them a certified letter with the copy of the agreement.

Unfortunately I don't have anything.Anyway,they are a stat run doctor office(OU MEdical) and there is no statute of limitations to collect,they can go back 20 years,according to them. :( ...Karen

The information given to you might be wrong. You need to confirm it. Medical debts are unsecured debts and needless to say, they also run out of the statutes. This CA will enforce you to make a small payment in the beginning so that the SOL (if it has expired) gets renewed. Then, the debt needs to be paid back in any case. Try contacting the doctor's office and get more details about this account. They will be a better help.

I just recieve a letter in the mail from these people for a debt from 1997 with MCI. Send then letter for validation over a week ago and just got the CMMR pack yesterday. No payments have been made.

ARSen-this infor I got was from the doctors office. They informed me since it was a state agency,there is no statute,etc.I will find out if it is about his medical bill from 2000,2001 if they sent it to collection. The Dean of OU medicine was just on TV last night saying they do not turn over to collections people who are on disability,talking about another case. So if this is turned over,I am writing directly to him...Karen

You are going to need to have a PoA, the debtor write in or verbally give permission for you to handle the debt. If a collection agengy talks to a thrid party and gives detailed information it's grounds for legal action.

Bossy if you are your son's official payee representative you have every legal right to discuss his finances, you are in control of his money. And the medical bills for the state do have to follow the SOL. Have your son write a statement giving you permission to discuss his debt and fax/mail that release of info. to them. Also, I don't know if your son receives Medicaid, or if he does if he has a spenddown each month, but you can use those old medical debts to his advantage and have them applied to his monthly medicaid spenddown. That is if he has medicaid and is required to have a monthly spenddown in order to have his medicaid card released.

I've dealt with this company in the past. I sent a letter asking them to validate my debt. Never heard from them. Needless to say, I had the credit bureaus to do an investigation and the debt ended up being removed from my credit reports. My debt with them was for Sprint, if I recall correctly. Anyway, if I were you I would dispute it on your credit report if it is showing up and see what happens. They could very well remove the debt from your credit report, if he's paid the debts off.

I am having problems getting information from credit agencies on debts on my husbands credit report. I cannot find the contact information for many agencies and I need to know how to dispute these charges if I can't talk to the agency themselves. We have also been have also been having problems getting validations from collection agencies. What should we do if they won't send us any type of validation? Any help would be greatly appreciated. You should also force the collector to validate the debt because they have entered negative remarks in your file. They must supply that info to you. If they don't respond to your validation request, use utmost legal power saying that they are violating the FCRA laws by putting incorrect negative remarks. If they don't remove the info at the earliest, you'll hire an attorney and sue them up to the extent of the damages done.

Payee and Power of Attorney are two different things. I am the payee for my son but, if he were of age, that does not give legal ground to use as leverage to get personal information from any company holding said information. It just gives me legal ground to disuprse his money as I see fit in his intrest.
Collection Letter
I received a letter from this agency today, requesting almost $900 from something from 2001. They did not state the name of the company, only a vendor code which frusterated me. Im THINKING it's from an old cell bill from 2001 from Verizon wireless which we repeatedly tried to pay off 4 years ago, only no such company existed to pay it off too (they were no longer verizon wireless as of 2002).
We talked to equifax and the other colelction agencies who had no further info for us but to dispute the mark.
Now that this has been sent to us- what should we do? I was very suspiciouse of the letter mostly because it did not have the name of the creditor, and just a code and Pin #? Are we able to dispute this and get it written off?

Send the collection agency a debt validation letter, return reciept. You may also want to send a cease and desist letter that limits communications to letter form only. I would dispute with the credit reporting agencies, too.
If you are positive that the debt is beyond the statute of limitations, you do have the right to send a full cease and desist letter. You have the right to send one whenever, but it is usually a poor idea to use it when the SOL is still in effect--it frequently triggers a lawsuit.
