Unjust Lawsuit
I was served a lawsuit by an attorney's office who is a debt collector; a debt that I'd been making consistent monthly payments on for the past year even though the account was in past due status due to accumulated late fees and overlimit charges,which occurred during some financial difficulty. During the sudden death of my father, I had to leave the state, and consequently did not get my payment in on time. By the time I returned, my account had been referred to an attorney's office for collection even though I tried to contact my creditor prior to the late payment. A week later a Marshall showed up at my door with a lawsuit. I have since returned my Answer to the Clerk of Court in my County which was sent to the attorney's office who contacted me indicating a judgememt could be filed against me if I don't contact them to resolve this matter. It is by no means my intent not to pay. I just want to know my rights in dealing with this attorney's office. Thank you for your response.

If your creditor has not sold the account to the attorney, you can still make payment to the credit company without dealing with the attorney. Call up your creditor and know the present situation of this account. It is possible that your account will catch up with the interests and other financial charges if you have not been paying the debt. The details must be given to you in writing by the attorney and/or the credit company.
After you have reviewed the details properly, you can make arrangements and pay off the account. The changes will be reflected in your credit file also.

I have a friend who is trying to get her child back. The problem is the father's family is friends with the preciding judge of this case. My question is how can she get another judge to oversee her case so she can get a fair trial? The child in question is in unstable and possibly dangerous care so it is important for her to get him back as quickly as possible. If we could at least get an address so we could write the state attorney general we would greatly appreciat it. Thank you.
