I'm tired of these RUDE collectors

Is there somewhere in their training manual that says collectors are to be rude to get money from folks in debt.

This woman from Riscuity contact me at my workplace which is against the law. I told her I didn't have money to give them today. She asked for my HR department, and I told her no and hung up.

Then she left a NASTY message on my voicemail, saying that me as an educator (I'm an administrative assistant that works for a school) how would it look if my students knew I didn't pay bills.

1. I work at a university, yes; but what makes her think I make a lot of money. If I tell you which university I work for, you would take a step back (hint: its in CA).

2. Where in the heck does a collection company have a right to talk to you any kind of way because you owe them money. They didn't wake me this morning, they are not my parents; and they don't supply my daily needs; so its okay for collectors to tell me i'm a terrible person; gossip on me, etc.

I don't know for sure if this company will really do anything about it; but I really want to address her personally by letter; but I'm sure that will not do.

If collectors want their money back, at least show some compassion....

...or maybe they are rude because they are getting the same calls.


Unfortunately, there is nothing in the fdcpa which requires collectors to be civil. My guess is that they are rude because they deal with many who have no desire to pay their bills and they have become jaded and lumped everyone in the "deadbeat" category. The collector you spoke with asked for human resources to do an employment verification and was using the line as a scare tactic. She would not have disclosed any personal info regarding your debt. Relax, get an address and request validation via Certified Mail/Return Receipt Requested. That will keep them off your back for at least 30 days, maybe even for good.

Don't know tha I would write her a personal letter-migh stir something up. What I would do, is do the DV letter,certified,and a ceasse and desist,that you only be contacted by mail. Also,keep records of who you tlalk to,dates,what was said,etc.,for yourself,in case anything comes up you need to prove.Good luck...Karen

Go through the fdcpa laws mentioned in the FTC website. This will educate you about the collection agencies practices while collecting debt from the people. The CA must follow every point mentioned in the FDCPA.

In which state do you live? If you want to stand strong against the collection agency and have some proof of their violation, you can record their phone calls. Check the laws in your state if you are willing to tape the conversation. In some states, you need to have permission of both the parties.

Here is a sample of the cease and desist letter. Send it to the company's mailing address. The company must not call you again (unless to notify you any legal actions) after receiving your letter. Send it through certified mail and keep a copy documented in your file for records.

Riscuity will stop at nothing to harass people. They threaten people thinking that will make them pay quicker. Record all phone conversations with Riscuity and be sure to get their names. You can send them a debt validation letter certified mail with return receipt, but Riscuity normally doesn't validate the debt. I found that our from first hand experience. They were trying to collect on a pdl that was paid in full and I have proof. I was told by Maria that I had to fax the proof to their legal department. I contact the pdl that we had the loan with and they stated our account was showing closed and they never referred any accounts to them.

I'm surprised that so many people wouldn't go ahead and deal with the original creditor/merchant. I have had tremendous success with that each time I have tried..then again, maybe I just got lucky. I DO know that often, when you explain the ins and outs of your situation to them, that sometimes they'll work with you. The companies, well, haven't seen that to date, at least not in the same fashion the original will work with ya...

I have tried a few times to deal with the original creditor after account has been turned over to collection agency....I haven't had any luck, was told the accounts were charged off and no longer owned by the original creditor. How can you get the original creditor to work with you in this type of situation?? Blessings, Melissa

this particular subject offended me, because its agents like this lady who make my job a living nightmare...
IT IS ILLEGAL FOR US TO CONTACT A TEACHER AT WORK.. fdcpa ... Well, teachers, fast food employees, hospital surgical staff, factory workers, and then if she did threaten you on your voice mail i hope you didnt delete it, that should go to the BBB. she was out of line in so many different ways ( as was the ---idiot--- who made the derogatory remarks before)

and unfortunately we aren't trained to be nice, imagine what things were like before the fdcpa came into power, my boss used to tell me about those days. but there are the collectors like myself and a few others who try to make this as painless as possible, so far so good, i got a promotion quicker than you could say fdcpa from being nice, but firm.
if only these people would learn a little human relation skills before thinking they can collect on debts.

It's a huge misconception that kmost collection agencies don't get their money if you pay the creditor. It's usualy stated into the contract between agency and client that they still get paid reguardless if you pay th em or the agency.

Being rude isn't against the rule. I'm not personaly rude but I know some who are. For each rude debt collector though there are thousnads of rude hostile debtors. You can't really blame a collector for getting upset with you if they think you are purposely treying to avoid paying a bill. It's not nice but it happens.

If you were to write a collector a letter it's highly doubtful they would ever get it.

Also, it's not illegal to contact you at work unless you tell them to not call you at work. then it becomes illegal.

And that provides for them did provide for you. You got a loan from them that forwhatever reason caused you to default.
