At the beginning of the week, my mom calls and says someone left a message for me at her house to "call the office". They gave a number, that's it. So I called the number, and it was a collection agency named OSI. I then got into a 45 minute discussion with a man who kept calling me "dear" And "babe". He informed me I owed $179 for the credit card. I'm sure that I do owe this, but I wanted it validated, and I told him so. He said "that's fine, but lets do a post-dated check over the phone today, so when you get the validation you can call and give the go-ahead." Um, no...I told him that wouldn't work, I'd send him a money order as soon as I got validation. He argued with me..Telling me that the check would be post dated. I said how do I know that? It's over the phone! He says "you're just going to have to trust me". I hung up.
I wrote a validation letter, and sent it to them. They call me every day now. I won't answer until I get that validation. They're leaving messages saying that it's going to be charged off because I refuse to make arrangements..They even called today, Sunday!!
So anyway..2 questions..Anyone ever heard of them, and is it REALLY against the law for a CA to call on a Sunday?

You can request no phone calls on Sunday. OSI is one of the worst collection agencies. They tried to collect on one of our pdls and they are the most rude collectors out there. THey will harass on the phone at home and at work. They have no regard for the fdcpa. Here is some info for you.

What if there were an organization that rode herd on the CA's and you could call THEM at the most inopportune times and be rude and degrading to them and make THEM feel like whale snot. THAT, would be cool. Of course, it would also drag you down to their level, and that's not even worth it to me. But the look on some of their faces....heh heh heh

I would answer one of their calls when you think they've received your validation letter. If they say they have not, then get their fax number and fax them one!
See if they will fax back a validation for the debt too while they're at it, then this can be resolved immediately.

As far as Sunday goes, as long as the calls were made between 8AM and 9PM where you live, they were fdcpa compliant. God may rest on Sunday, but nothing in the Act says collectors have to do so. However, states can add more consumer protections to the FDCPA. (They just can't reduce them.) You may want to check Michigan's version of the Act.
Some relevant excerpts from the FDCPA vis-a-vis debt collectors soliciting post-dated checks:

Although, you cannot prove those words that is something against the law but it actually shows how unethical this CA is. They don't have a good standard of doing their business. It's unprofessional. Have you thought about recording the phone calls to see if they violate the laws?
