Capitol Collection faxed a letter containing a Complaint for Warrant regarding a payday loan. It states that i be apprehended and held. I've written to these people twice stating that i am able to make payments on this debt. To date I have no received any response. Can they really issue a warrant for my arrest? They faxed this letter to my place of employment where everyone pulls faxes from the machines. Is this a violation of my privacy? Who knows how many people here saw it and are spreading rumors.

Stand strong dealing with this CA. It is not normal sending you the collection notice through fax that can be viewed by all. Under the laws, the account must also be validated in writing to make sure that they are authorized for the collections. Don't end up paying to the wrong company. Send a debt validation letter if you haven't received anything in the mail. Read the fdcpa and arm yourself legally when contacted by the CA.

The collection agencies are bound to follow the fdcpa. Threatening legal actions is one of the violations in the federal law. Start recording the phone calls if your state laws allow doing it secretly. You will gather legal proof and take actions against them. The CA is trying to intimidate you. You need to strike them back strongly.

collection agencies rarely drop the matter. They will make their disturbing calls and try to offend people. It will be best for you to cover your entire basis legally. Once you have sent the debt validation requesting for the account details, there is nothing much they can do against you. If the matter is taken to the court also, they will have to prove with the necessary information first and the judge makes decision in your favor. Keep a check in your credit report also if they are hitting anything inaccurately.
