My husband has been contacted also by Allied. They have never sent mail or contacted us at home, but have called my husbands work and told the HR dept if he didnt call that day, he would hear from them tomorrow in a bad way. This is the only time we have ever heard anything about them. When my husband got home and called, the man didnt want to tell him anything about the debt. They even told HR they were the DOE. Finally my husband found out they are trying to collect on a student loan that was dismissed in bankruptcy back in 1988! The man said we can do this the easy way or the hard way and my husband told him he wasnt paying on a debt that was dismissed by the US Bankruptcy Court 18 years ago. The man said we will just garnish your wages and see about that and hung up. Why should we have to try and deal with something now that the federal government said in 1988 that we didnt have to pay? How do we keep them from taking money from my husband check over an old banrkruptcy that is now in the archives at the courts? WHy file for protection when years later some crook can try to collect again and cause you to problems. We thouht this was over 18 years ago and this is the first anyone has ever mentioned it again. What do we do now?

Most importantly, AI cannot attempt collections with putting the debt in writing. If they are unable to do so, send a debt validation from your side and cover your basis legally. Once they manage to send the information in writing, send a letter with your dispute explaining the facts. You will have done what should have been done at the situation. Do all your correspondences in writing and through certified mail/return receipt requested for records.
DISMISSED BANKRUPTCY...
Since you had a dismissed bankruptcy, they can never collect b/c they need to update cbr 18 yrs ago about this. Get a lawyer and one that know what he is talking about to dimiss this once again. Its a headache but its worth it.
