I am having a TERRIBLE experience with this company. After first speaking to them on the phone I felt ok. Then after replaying the conversation in my head I started to get nervous. Once I received the paperwork in the mail I was positive this was not a company I wanted to help handle my finances. In the paperwork there were SEVERAL spelling errors and the fees quoted to me over the phone were much different then what was in the paperwork. Also, there was not a breakdown of why I was paying the amounts I was paying. The only amounts listed were the fee amounts. I had no idea and nothing in writing how those amounts came to be. I called CCCA immediately to ask questions about the difference in fees and why the contract did not spell everything out. I was advise my a supervisor there that this is "general contract" and the fees listed in my contract are for consolidation, not settlement, but they have in their computer all the correct amounts and for me not to worry. Ya right, I don't think so. I advise him I didn't feel that was very professional as well as the SEVERAL spelling errors in the paperwork caused a red flag to go up in my head. He replied "well no ones perfect and everyone makes mistakes". I had to agree with him but advised him I would not be pursuing with his company. he said that was fine however the initial fee of $377 was still going to be drafted from my account for work they have done for me so far.I advise him that I was told NOTHING could be done on my account until the the first payment had been received. So...exactly what work had they done? Have you contacted my creditors already? he stated no not until the first fee has been received however all the research has been done and paperwork prepared. I immediately sent him a letter via fax and e-mail advising I was terminating any/all relationshiop with CCCA/Hess Kennedy & advising the DO NOT have my permission to draft any amount from my bank account. I was stupid enough to give them this information over the phone when I first spoke with them as they advised it was better for them to have it all typed up & on the contract when they sent it to me. They stated this would ensure my account was acted upon promptly and my creditors contacted. In my letter I also advised them to send me an itemized statement of fees accrued due to work on my account as of 7/31. I have sent him (cc'd Hess Kennedy also) 3 e-mails and left 2 voicemails with no response. I was under the impression nothing was final I signed the contract they sent me. They are not under the same impression. It was originally agreed I would pay the first payment 8/4. I guess we'll see if they try to draft. I have emptied by account however of all funds, so if they do try to draft I will only be charged the NSF fee and not the $377 they state I owe them.


My point exactly!! I was under the impression they would send me the paperwork, I would review and them make the decision if I wanted to go with them or not. Apparently they feel a conversation over the phone is a legally binding contract. If these people are lawyers or have laywers handling these accounts, wouldn't they know a conversation is not a contract? I still have had no response from the supervisor at CCCA or anyone at Hess Kennedy.

In the meantime I have contacted T & C and have nothing but good things to say about them!! They are wonderful and have been EXTREMELY helpful

We only had a date set to be pulled for August 4th because that is when you wanted us to pull. There needs to be a date in place for payments to come out so your creditors can get paid every month. I will definately talk to your counselor to make sure there is not any confusion for other clients.

You want to cancel and nothing will be pulled from your bank account. I can assure you that your account will not be debited. We know exactly who you are because I received an email yesterday to cancel your transaction. It is canceled! We are here to help you get rid of debt and start building wealth.

The reason we set everything up initially over the phone is to insure your account is set up by the time you get your contracts back to us. In certain cases we have had clients very upset because they gave us a date to pull over the phone and we did not pull into the contracts were back. They called very mad because the account got delayed and in turn made them late. The client held us responsible for the late fees because they gave us permission to pull over the phone and we did not. Either way we try to make sure to do the right thing that would benifit you.

Your account has been canceled and I am sincerely sorry for the confusion. If you have any questions anytime in the future please call us and we would gladly help you.

You are correct, I initially had planned for the first payment to be taken out 8/4. I assumed this would be made final when I signed and sent the contract back.

The problem and confusion started when I was advised otherwise by a supervisor at CCCA. He advised me, yes we will cancel your account however the first draft will still occur to cover the fees that have accrued thus far.

We are all on this website to help take care of our debt, not make it worse. I sincerely hopethis problem has been resolved and future clients of yours have a much better experience than I.

I really do appreciate your reply as I have yet to receive any type of official reply to the 3 e-mails sent and 2 voicemails that I have left.

So I did receive a voicemail from the supervisor at CCCA advising they received my letter & things have been cancelled with them. Nothing was noted about the debit for the initial fees. I guess I will wait and see what happens in the next few days and see if they try to debit my account..

Ms. G your story exactly like mine. Wish I would've read it before! I never sent the contract and was also the understanding about no payment until any contract was received.

Glad to hear it's worked out for you, so far.

What is the e-mail address and fax number you used, so I can go the same route?

Please help! I have already signed the paperwork back in March. Creditors still continue to call almost daily. I spoke to one about an hour ago and was told that they have not received a proposal yet. Hess Kennedey's operators' are always busy and my calls are never returned. I have sent nearly 50 emails with out response either. I will be cancelling the automatic withdrawl as they have taken several hundred dollars already. I am now deeper in debt and seemingly nowhere to go.
