my sister bought a car and she moved and stop paying her car note, i myself don't know where she lives now. her car people keeps calling me at my job and coming by the house harrassing us and i keep telling them that she don't live there and they said they are going to be watching the house for her what can i do?


Is this a used car lot or a new car dealer she bought the car from. I ama sking becasue I use to work for a used car dealer. I know that when he didn't receive payments or got a bad check he did go to the customers house. I live in pennsylvania and we have Constables. They are like police in that they can arrest people who have warrants out on them, evict people and repo cars. If they are truly watching your house and it is just a person from the dealership, I would call the police and tell them your situation. I would make sure that someone really is watching before you called. I think the only people who can do that is someone from the repo company who is waiting to tow the vehicle.

I have a question for you. :)

Suppose, if I am in this situation as described above and have not jointly signed for the car note with the actual person, will the company take actions against me or my family members when he/she is not found in the area? Can the company seize my property or issue a warrant against one of the family members? Keep in mind that nobody jointly signed anything with the actual person for the car note.

Absolutely not. If your name is not listed as a co-signer on the loan then you are not responsible for this. I am curious about how they got your name. Did she live with you at the time the loan was taken out. If they continue to call you or other family numbers i would report them. you can do a call trace after every phone call. The number is automatically recorded at the phone company. Once you receive about 10 calls then call the phone company and they can be reported for harrasment. I would also send this dealership a letter stating that you do not have any contact with this individual and to refrain from calling you at work.

sorry, i thought you were jarrell. But the same situation applies to you. if your name is not on a car loan or any loan, you cannot be held responsible. they may contact you if you were listed as a reference. they will jus ask if you know this person and may want to know if you know where they can be reached. they can't squeeze any money out of you.

Never mind, brendacovey. :) I still get the point.

Theoretically it seems to be so easy but practically, it looks so tough to convince the company that there is not trace about of the actual person. My sister is going through the same situation and well, she didn't sign anything jointly with the person. But imagine, these people appear from a completely different planet not understanding the facts.

I know. They automatically assume you are lying and covering for the person. They did that to my parents. I defaulted on a student loan and they called my parents, even though my parents had nothing to do with it. I had to get the student loan because my parents could not pay for my education. My dad told them to basically f*** off. I called the CA and told them to leave my parents alone! My parents never got a call again.
Just tell your sister that nothing can happen to her. If she keeps getting calls just telll her to follow the instructions in my previous post
