Phone Call from a collection agency
Date: Mon, 05/22/2006 - 07:07
On Thursday, I received a phone call from a collection agency stating that I need to call them by Friday otherwise they are sending my file to a lawyer for legal action. That day I sent out a debt verfication letter by certified mail. I don't know who these people are or what debt they said I owe. How can they demand that I have to call them by one day or I will get legal action.
They can't. The're trying to scare you into paying them money.
They can't. The're trying to scare you into paying them money. You did right by sending a debt validation letter CMRR. If they don't respond don't worry about it. Even if they try to take you to court, they don't have a leg to stand on because as of yet they have not validated the debt. That would be in violation of the FCRA and the fdcpa.

Hi thehun
Keep the receipt of your certified mail in safe place. This receipt is an important proof of your efforts made towards knowing the details of the account. Check your credit report and know the list of accounts with details of the creditors. You can get in touch with them and arrange payments so that you don't have to deal with the CAs.

If this was the first time they've called, then in 5 days they have to send you a collection letter. If you don't receive one then it is a fdcpa violation. Could be money in your pocket. Keep us posted.

They can do that. And indeed some companies will. However if they say they are going to do it then they by law have to actualy take the action. An agency can not threaten legal action unless they are fully prepared to go into the entire process.
They did not make you aware of the matter they were calling in reguards to? Did you speak with this or is this a recording? Since you aquired an address I am going to assume you spoke with them and tell you that it is so bizarre that they wouldn't inform you of what account this is for.
In the mean time, while waiting for your validation letter, I suggest you pull a CBR and look for any outstanding activity or unusual activity and contact the original client immediatly.
