Collection agency on my Credit Report

I had a credit card from 1999 and was charged off in 2000. However, a collection agency has put it on my credit report as of December 2005. This debt would be coming off of my credit report next year, but now that it has been bought by this agency, is it still able to stay on my credit report for another 7 years? It doesn't seem that it would be legal to do that. How can I fix this? Is there a way? Besides the obvious answer of paying it? Please help!!!! Thank you!

Before you pay anything to the collection agency, you must make sure that they are authorized for the collections. Most of the CA's make contact with the people without any legitimate details of the accounts. Under the federal laws, the debt should be validated by them in writing before you make any agreement further.

If the collection agency has hit your credit file without a genuine purpose, you must take actions against them for fraudulently hitting at your report.

Negative information stays in the credit report for a period of seven years. It begins from the date of first delinquency. The CAs cannot change the dates by reaging the accounts. There are some CA's who do such things deliberately in order to keep negative information in the file for longer period.

I also believe that this debt might be out of the SOL period by this time because of no payment activity. Hence, the CA cannot force you to make payment on this account. They will insist you to make a small payment so that the SOL can be renewed from the beginning and thus force actions.

Hi Cara,

Why don't you register and join our community, the members here are real fine people and will help you understand how to deal with your problems.

As David said, check your state statutes to see what your SOL is. It doesn't matter how many CAs work your cc, its 7 yrs from charge off date and it will fall of your CR. It might not fall off, you might have to give CRAs a shove.
