As soon as I walk through the my front door today, my father in law hands my husband a msg that a "Nelson" called and told him that he had a "hot check" and would he give the msg to my husband. So he did.
My husband calls him and this guy "Nelson" says that my husband bounced a check with his payday loan company and then begins to tell my husband his social security #, date of birth, etc. in order to verify that my husband did take out the payday loan online from his company back in July 2005. Mind you, our home # has been the same for over two years now and this guy says that he has been trying to get a hold of my husband since last summer.
My husband tells him that he did take out a payday loan with a different company and that it was paid. It was because I remember him telling me and it was on our bank statement at that time. We no longer have that account. My husband asks him to send the paperwork for the loan to prove that he owes the money $495 and the guy says "I aint sendin you nothin."
So my husband tell him "I'm sorry but if you can't send me any paperwork then I refuse to talk to you" and hung up.
This guy is calling our in laws home. He calls back 4 times in less than 2 minutes. I'm NOT kidding or over exagerating. So I tell my husband to let me talk to him if he calls again. He does less than 2 seconds later. I pick up the phone and ask him if he minds that I record the conversation and he said "Oh no. Not at all. We're recording it from this end too."
Here's the convo in a nutshell while it's still fresh.
Him: Ma'am, I don't want to start a confrontation with you but since (husbands name) is disputing this I need more information and I've repeated all of his info to him so it's obvious to me that he did take out the loan and he owe's us $495."
Me: Well, since you say you have all of his info then you should have our phone # too, right?"
Him: Well yeah but he gave this # (my inlaws #) as a reference # and your sister (my sis in law).
Me: Let me ask you a question.. If my husband took out this loan online in July, then you need to send us some documentation stating that he did AND just so you know, if my memory serves me correctly, we did not have internet access at that time."
Him: Well who in the home would have access to all of your husbands information?
Me: I dunno. I don't but obviously he knows his own info.
Him: Well maybe you took out the loan.
Me: Oh, so now I'M the one who took out the loan? Can you prove it? Did you not hear me? We did not have internet access at that time to the best of my knowledge and the one loan my husband did take out was paid back.
Him: Maybe you're the one who took out the loan. Is his attorney available so that we can discuss this in a more professional manner to get this resolved?
We kept going back and forth about whether or not my husband or I took out the loan and then I got frustrated.
Me: Sir, if you have all of his info then you would also have our phone #. You are calling my in laws and I am requesting on their behalf that you NOT call this # anymore. If you need to speak with my husband call OUR #. The # you state you've been trying to call since July.
Him: I'll call (insert sis in laws name). I'll call whoever I want!
Me: Sir, I have asked you to not call this # anymore. If you do call again, we will file charges against you and your company.
Him: I will call whoever I want! (I think he was throwing a tantrum by now) LOL. Collection is my LIFE!
Me: Sir, if you have our f***ng # use it.
Him: Ma'am, your cursing left and right isn't going to help the situation and won't do you very good in the long run.
Me: You accusing ME of taking out a loan is illegal. You calling my in laws 4 times in less than 2 mins is illegal. If you call here again we will file charges and complaints against you and your company. Goodbye.
I hung up and about five mins later I get a call from my sis in law. She says that he had just called her in a panic and said that he needed to get a hold of my husband immediately. She said that she told him that if he calls her again she is going to file charges.
So I'm wondering...if my husband did take out a loan don't they have to prove it somehow?

They should serve you some proof especially when you have disput
They should serve you some proof especially when you have disputed, to the best of my knowledge. Now they would claim so many things out of the blue. I wonder how they got a hold of his SS # and all the ph #. You have dealt with another company in past right? What is the name of that company? And do you have any proof of payment made to them?
