collectors call my house looking for wrong person

Hello ,

I really have a problem with debt collectors.
My brother was staying at my house for a brief 2 months , having his bills sent to my address.
Now , after 2 years , while he get in debt , the collectors keep calling my house , looking for my brother. Also I get a lot of mail from debt collection agencies.
Because I don't want to give any info regarding my brother, the collectors keep calling.
I returned the mail , but without successs.
What do I have to do to identify the collectors and STOP these calls for good ?

Hi, welcome to the forums.

Because your brother used your phone number as a contact, they can call to ask for his whereabouts. There are boundaries that they can't cross, however. Calling everyday is one of them. If they're calling gets out of hand, simply send out a cease contact letter, stating he no longer lives at your address, you are unknown of his whereabouts, and you wish for their calling to cease.

If they calls continue, you can file a complaint with the BBB, and the attorney general.

I would call your brother up and say, hey buddy get these peple off my back and call them to get your things taken care of.

Make sure that no one is giving your number out as his contact number, including your brother himself. Hey, don't get offended you would be suprised at how many times it has happened.

Then I would suggest you answer the phone and explain to each company that he no longer lives here. Take the name of the rep and the company down. Explain that you are tired of them calling all the time and the next conversation you will have should they call again will either be to their supervisor or your attorney.

Also, and this is important esecialy since I know how much collectors are hated. If you yell and be extremely rude and they hang up before you can get your message across you are just going to have to wait until the next time they call because you betcha they did not take that number out even if you didn't get that far in explaining things. If it is m ore than one company its going to be a rinse and repeat process until you get them all.

How about something like this:

Dear Butthead Collection Agency,

Your agency has repeatedly called my home looking for My Brother (insert brother's name instead of My Brother). This is to notify you in writing that this person no longer lives at this address nor can he be reached at this phone number. I am formally requesting no further contact from you, written or phone, in this matter.

I am sure you realize that federal law requires that you honor this written request. I expect your full cooperation in this matter. Any further phone calls will be reported to the appropriate federal agency.

It is true that they can call your house if your brother gave that phone number. HOWEVER, you are under NO obligation to give them ANY information about your brother or his whereabouts. They are prohibited by federal law from contacting you after this written letter, except to notify you that there will be no further contact.

Hope this helps. You might want to send the letter with return receipt requested.

I have found that collection agencies harrass anyone who has ever lived at an adress that a bill is "supposedly" owed. it can be a bill from many years ago or a bill that never exsisted.They dont care and they will file negative reportds on your credit file if YOU dont pay the bills that they are well aware that you dont owe. NCO has tried to pull this crap on me because of the people who used to live in the apartment above me years before I moved in. The result, daily harrassment when I worked midnights, lying that my number was the number on the phone bill wich was BS because I had the number for 3 years and transfered it to this adress wich was the appartment downstairs, telling me that they " had their ways" of finding out if I was lying and telling me that they could destroy my credit becasue " if I knew so much about them, why didnt I know where they were" - I knew their last name because there was still mail comming to the adress 2 years after they moved out and their last name was 6 letters longer than mine so the credit fraudster was either a moron or liar. Apparently that was enough to make me responsible for their bill and punished by keeping me awake during what would be my sleeping hours.

But thats ok, NCO "has their ways" - so long as they have their theft jobs everyone else can suffer in their legitimate jobs.

We had the same situation a while back.
My wife's, then x-boyfriend, used to live there and had a lot of bad debts he just let go and go.

The kinda guy that wakes up in the morning, starts drinking last nights open beer, and continues all day and night, passes out, wakes up, starts again.

(Which is also why she had problems paying her bills because he wouldn't work, she had to pay the rent/bills herself and ran into debt herself, and
the reason I'm here getting all the info I can on how to handle it. )

This guy finally moved to SC and ended up loosing a condo, because he couldn't hold a job long enough to afford a 250.00 a month morgage! Sad.

They would call her place and I'd answer, hearing a guys voice they start into their stuff of how I owe this and that.

Wo-wo buddy, I'm not him...but....
I'll be more than happy to give you ALL his current information.... silence....

He is living at -street, city, zip - and his
phone number is xxx.

Again... silence...

Astonished over the free info, they'd now ask,
Why are you so forth-coming with this info?

I'd respond, this little man caused soo many problems for my girlfriend (now wife) that I am more than happy to help you, get him, or at least p!ss him off!
