I orginally sent this as a PM to answer someone's question, but I want to be of service to as many people as possible, so here you go.........

Its all about disputing items on your report, some say to go after the creditors themselves, some say the 3 credit bureau agencies.

I just blasted them all with letters.

So I found the addresses on my credit report and sent them all letters, (return receipt of course).

In the letters, I wrote them and told them that the Statue of Limitations had run out OR that it had been 7 years since the ORIGINAL DELINQUENCY or Both and that the items should come off my credit report.

I then wrote the 3 agencies and disputed with them as well.

Most of the information on the report is incorrect, for example...

I had something on my credit bureau reports from a collection agency called NCI Financial.

I called NCI them and found out that MCI phone service was the original debtor. I knew that I hadn't had phone service with MCI since 98 or sooner. So I called MCI which is now Verizon and asked them to find my last bill, it took several phone transfers but I found the right department and sure enough they mailed me my final bill which was from 1997. (Clearly past the 7 years it could be on any report or the 4 years for the SOL).

Once I had that old phone bill mailed to me, I mailed a copy to NCI Financial and told them to remove me from the report.

I also disputed the items with the bureaus giving them the same information.

Voila-The item is removed.

Here are a couple of great links where you can find Boilerplate letters to send to creditors.

http://fair-debt-collection.com/Disputing_Collections/SoL-dispute-letter.html

This site also explains some other things about creditors that is useful information.

Also, I use this letter a lot because it explains the 7 years from ORIGINAL DELINQUENCY.

http://www.ftc.gov/os/statutes/fcra/kosmerl.htm

This information is HUGE. Because most credit reports will say that it was first reported from a MUCH MORE RECENT DATE than the actual debt.

So if you have original bills, great. If not, you have to call orginal creditors and get them to send you proof. If they can't send you proof, guess what, it comes off the report!

So if they don't send you anything, report the dispute to the credit agencies because when the credit agencies don't hear back from them with the correct information, it comes off the report.

I hope this was not too confusing, I am happy to explain more if I can.

Good info, BMT. I will like to add the FCRA link here along with the good links you picked for all. Disputing incorrect items in the credit report is a must. They hurt the scoring system severely. Everyone should be known to FCRA laws so that it becomes easier to maintain your credit ratings.

There are laws that force CRAs, CAs, and creditors to report accurate information in the credit report. If anyone is trying to report negative inaccurate information for longer period, it will result violation of the Consumer Protection Act afforded by the FCRA. You can sue them on charges of defamation and willful injury up to the extent of damages caused.
