Guest, it seems they have sent at least few documents when you requested for validation, right? You can send them another letter mentioning clearly exactly what information you are looking for. As they have responded to your DV, they are likely to consider the debt as valid. That is the reason they are reporting it to credit bureaus.
Write them what information you need. Also negotiate with them and insist them to accept a payment plan.

Dispute the item with the CRA and they will conduct an investigation with the company. Inaccurate negative information should not be reported in your credit file. JDB has to remove the item from your file if there are no legitimate records about it.

Thanks for the info. I mailed letters, today, to the 3 CBs and the JDB. I told all of them I had asked for validation of a debt I don't know is mine, and I got no validation. I told them to remove the JBD's report on my CR.
Midland Credit Management
I have sent a letter to this company for a debt that is at least 9 years old. It did not appear on my credit report until last year. I first received a letter stating the debt and then after I discussed it with them over the phone, they reported it to the credit reporting agencies. They have not responded to verification of debt, which I gave them 30 days to supply me with proof of the debt. How do I find out the SOL for Indiana, if there is one?

truwoman31,
Based on the date of first delinquency, your account might be past the seven years period reporting time. Under the FCRA laws, negative information is allowed to stay in the file for seven years only. The company can insert the item in your file only if they can prove that the SOL is renewed for this account. This can happen if they have your agreement that you are willing to pay the debt now. SOL in Indiana is for 6 years. Did you make any commitment to pay the debt? If not, dispute the item with the bureau as it happens to be a fraudulent reporting done by the company. The CRA must provide you the actual proof for inserting this information in your file. If they cannot, your dispute will appear stronger

Do you need a validation letter or a verification letter? A validation letter is the one when you request the CA to provide the necessary information about your debt accounts. In this letter, they need to explain the company for which they are collecting along with the calculation of principal amount and interest charges.
After you have received this info, a verification letter is sent disputing the item (if any). Both of these letters have different lines.
Read the books section or browse through the sample letters to pick the appropriate one.

I never agreed to pay the debt. I filed bankruptcy several years ago and that account was on it. I asked the company to provide me with documentation for the debt because it just appeared on my credit report. I don't know if the account is valid or if someone opened the account in my name without my consent.

If the account was included in your bankruptcy discharge then send the agency trying to collect a letter stating that the debt was discharged in bankruptcy and is legally uncollectable. You may want to include a copy of the courts discharge order. They will be able to get the necessary information form that order to do a public records search for the necessary information. IF the account was discharged in bankruptcy and they they continue to try and collect after providing them this information, then contact the court that handled your filing and advise them that they are attempting to collect on a discharged account. The court should be able to help you proceed in stopping further collection activities.
If they still continue to collect, then contact the court which handled your filing and discharge that they are attempting to collect on a discharged debt.
If the account was not in the filing then they must validate the account. IF you do not believe that you ever had the account and that it may be fraudulent, then you should file a fraud alert with the 3 credit bureaus, and contact your local law enforcement agency and file and Identity theft report, then provide the police report to the agency trying to collect.
