Hello,

I live in Ohio and I am trying to help my mother relieve her payday loan situation. She got into a bad financial situation about 1 1/2 years ago using payday loans. She started with about six and over the last year we have been able to pay off 3 of them. All of these accounts were opened at Payday Loan stores in Ohio. Recently her job closed and she's not able to keep paying like she's been doing. She can pay something on all of them but not the full amount. What all would you recommend we do? I really want to help her get rid of these last 3 payday loans. She's been paying for a year and it's just not going anywhere.

Hi, welcome to the forums!

I would recommend obtaining a copy of what you have paid, thus far, from all the payday loan companies. If you've already paid off the load amount, and are only paying interest fees now, you could send a letter of demand to close out the loan, and show as paid in full.

Regards-
Mike

Hi, welcome to the forums!

Did you actually take out a payday loan? If so, have you paid back anything on it? Placing phone calls to your work, especially when you've told them to stop, is breaking the law. They cannot harass you at work. What is the name of the collection company that is calling you, and phone number if possible? I'd like to do some checking for you.

Remember to stand your ground. Insist they provide you with an address so you can send a letter of validation.

Regards-
Mike

mhall345, do not feel scared. Some companies use such scary tactics to get the money without any paperwork. You have your legal rights protected under the federal laws. No company is allowed to make threats while recovering money from people. Tell them that they are violating the laws and you will be reporting their conduct violations to the BBB and the local AG's office. Any debt needs to be put in writing before you send your payment. You must verify it thoroughly before making a payment agreement. Don't give out your checking account information to the company. They might say that you will be sent to jail if you don't pay back within the limited time. Stay cautious and know the laws in your state. These companies cannot do anything against you unless their is a legitimate proof.
