They have called me home a few times and I told them that I need a validation letter before I send them anything. They sent me an email but nothing through the mail and the email was very generic. It's always a man with a heavy thick accent that calls, generally his name is David Lawson. Today they called (Michael Peterson) stating that he is calling from their legal department and I am to call them back by Friday or they were going to issue a warrant for my arrest. From experience and information on this board I know that they can't threaten me with this. I have the call saved on my work voicemail.
Does collection agencies actually have a legel department? I am seriously thinking about reporting this company as they are very rude and unprofessional.
Any idea/suggestions would be appreciated.

Dana, I am not sure whether collection agencies have a legal dept. or not but that's the way, they like to attempt their collection procedures. You are aware of your legal rights and the CA must follow the federal laws by sending something to you in writing first. Don't make a payment agreement until you have verified their genuine purpose of collections.
Keep the recording as a backup in case you want to put your complaints at the local AG's office.
Do you know the name of the company for which Capital Collections is collecting? It will sound good if you can get in touch with them and inquire about your file. That might be an easier process.
