Just Recieved this email from Dennis at nationwide.
If I understand he say I dont fall under New Mexico Law. Good Now it is to Oklahoma
They should not have given me a loan since oklahoma laws say you can only have 2 at a time.

Quote:
Mr. Shaw:

Lynne Kennard referred your recent e-mail to my office. I strongly urge you to speak to counsel before engaging in further legal argument. You did not cut-and-paste the Small Loan Act into your last communication. You cut-and-pasted a bill filed by Senator Patty Lundstrom in the last legislature. Had that bill passed, it would have modified the Small Loan Act to create the payment plan you describe. However, you would not have been eligible for that plan because the bill applied only to New Mexico borrowers. In any event, the bill DID NOT PASS.

Competent counsel would have explained this to you and a great deal of misunderstanding would have been avoided.

Your loan is subject to the Small Loan Act as it exists today. There is no mandatory payout requirement and the only limitation of my client's fees is that the interest rate must drop to 10% if the loan extends beyond one year. One of my paralegals will be contacting you in the next few days to discuss your settlement options. If you do not settle, I am authorized to initiate binding arbitration and execute on any award.

Talk to the person concerned and make your payment arrangements. It seems they will be willing to work with you. In my suggestion, do not let this matter reach the stage of arbitration. You can consult with a debt counselor also and take some advice from him.

I also had an email and call from an Albert (did not want to give his full name or telephone number) This is how I found out that Ambassador was associated with Nationwide Cash. This loan was taken out in October for $300. I remember seeing that starting with the 5th payment an additional $50 would be deducted until the loan was paid in full. Albert told me I was wrong and under the loan agreement I had it was $50 additional every 5th pay. I aked for a copy and was told I should have it and it was taking too long to go through the emails I had sent asking. He told me he would take legal action and hung up. I live in Ohio and this was an internet loan. Is this possible?

Thanks. I talking with Nationwide Cash all they wanted was $640 but considering they have been taking atleast $150 a month from my account since October I think they have more than received their money especially when they made it impossible to contact. Since the conversation with Albert they hit my checking account with 10 different amounts which all were overdraft and then returned as I am not using that checking account and refuse to give them the information on the new one. Is there a listing of PDL's that are licensed in Ohio? I still have Magnum, One Click Cash, Ambassador and PRL. Also, isn't the state of Ohio you are only to have one loan?

Even if you are only allowed to have one loan in Ohio in my opinion you need to pay back at least what you borrowed. There are quite a few others on here who are from Ohio and can probably help you. Nationwide is difficult to deal with and you may be better off just making a payment plan with them and paying it off. Good luck!

Ya know, I just could not bring myself to send them $200 this pay when I know I have that loan paid off already. I need that money to pay my bills! I faxed them my letter just now. What kills me is I have had this loan for over 3 months. 105x6=$630.00. I had a $500.00 loan with them and I was quoted $515.00 to settle. What the heck!

I don't have a problem paying what I borrowed and the interest and fees. What I have a problem with is the sneekiness and inability to contact these places. I had sent an email and faxed back the information to On Click Cash to pay off the loan and it was never done. The loan just kept renewing itself.

I had a real problem paying triple digit interest when it is illegal to practice that kind of lending in my state. I paid enough into my pdl's that i paid them 3 times over in principal. It will never end if we don't put our foot down. They have to abid by state and federal laws. They can't make their own laws to run their business on. And, yes, some are very sneaky and hard to find. One pdl, I have yet to track down and they owe me over $200.00. They admitted it but I can't not find them. No email, no fax, no phone, they dissappeared.
