Hello, I've just received th court papers that my CA sued me. I was surprised because eventhough I received letters from this CA (Resurgent Financial) once in a while, they didn't really bug me much and now all of a sudden, I got served! What happened I had this credit card debt for over 3 years now and when this bank was bought by another bank which I also had a credit card debt with, I thought that they would combined both of my balances into one because all of a sudden my balance on this one was much higher (it was my fault because I was too busy with life back then and I just kept paying & paying without checking my statement. What am I gonna do now? I definitely want to ask for debt validation because the last payment I made was a bit more than 3 years ago before those 2 banks merged. Is it too late? If it is, what's the next step I should do? Thank you very much for your help!


I think originally it was only around $3k. Now, on the papers I received, it's more than $8k. The date that was stamped on papers is May 19, but I didn't receive it until May 31, so I assume I have until the end of this month to resolve it, right? I was just so busy back then with school & work that I was late with payments and when my other credit card bank (Chase) bought that bank, I assume that Chase would combined both of my debts into one because the balance was all of sudden higher. As a matter of fact, I'm still paying Chase every month now. Is it still ok now to send a DV request to my CA now or do I have to file in a proper court form (Answer to Complain (Form 982.1)? What should I do now?

I will consult an attorney in this regard since it is taking a legal stand. He will advise you the proper move as per the situation. You are paying your debt with Chase regularly and failed to be notified about the debt with the previous bank. Under these circumstances, Chase is taking actions for not paying the previous debts. I may think at this time that Chase will be willing to settle the matter with you because you are already regular in your payments with them. This may place you in a safer side. You need to get someone in person and get the matter settled with the help of your attorney. Talking to the CA won't be helpful if the credit company has a case against you.
