NAFS CA Can they do this?

Received a somewhat disturbing call from NAFS. They claim they can place a lien on my home..Have been making payments with them for the past 6 months. Now all of a sudden that amount is not suffecient. Either settle for lower amount due on account or commit to a payment plan, that I am unable to afford. Didn't commit to anything, said would have to look into.
Last payment they received cleared my bank on 6-1-06
Live in Illinois.
OC was I believe was Household. It was a credit card for the Store COMP USA.
Any help or direction would be greatly appreciated.


Thanks for some insight. I didn't think so. Granted the amount owed is$8,000.00, however I didn't think was high enough for a lien !?!?. Now they just left another message today. Stating she has called numerous times and left messages (the 1st was friday today was the 2nd) that I know the situation, that this is getting ridiculous and by me avoiding her calls is only making it worst. If necessary will contact my husband.. Who by the way is NOT on the account and never was... This I know they can't do or at least shouldn't. I thought CA could not or are not suppose to threaten you with A) something they can't do and B) something they aren't going to do.

Sold to Sherman
Now with NAFS, whom I believe is part of Sherman.
I can afford what I can afford nothing more...

Terh, have you sent a cease and desist letter to the collection agency. The company must stop calling you after receiving your cease and desist letter. If they still try to contact you, you have the legal rights to file charges against them. Read the FDCPA laws and practice your legal rights while dealing with the CAs.

Hello, I was reading this post. They cannot put a lien on your home. credit card debt is unsecured. Your home is a secured debt. If you dont pay they will take it. Contact you AG in your state. Or in your case get an attorney... Do not let these people drive you crazy. I went through the same ordeal. They CANNOT take your home. Only threats. Good Luck KYSIDE

Kyside38 Good Evening. I didn't think they could touch my home, but you never know. Always nice to know where you stand. They are now calling asking for myself or my husband by name. He is NOT on this debt. If necessary and a attorney is needed, hope I can find a decent one fairly priced.

Terch, I was in this mess myself. Credit Card companies threating to take my home. That is how I ended up in the payday loan mess. Also my husband did not know. I had to file bankruptcy. This is how I can personally tell you that they cannot touch your home. I more than paid the credit cards off. Also all the payday loans were paid with very high interest. My Attorney General is helping me to recover some of the interest I lost cannot recover principal. Look in your area for a legal aide lawyer. They are based on your income.
