Calling before 8am?

Chase has called me twice before 8am... the first time, well, it was a minute, i admit it. The second time, 5 minutes before. All I have is a cell phone so my time comes directly from the tower. Am I being nitpicky or what? Seems to me 8am means 8am. I'm sure if I did something like that to them they'd swarm all over me like flying monkeys.


Well, they're not supposed to do it..But it is pretty close. I remember when i was dealing with Interim cash, they called my house between 9:45 and 10:pm a couple times. Once I asked the man I was talking to if he knew what time it was..He told me that he was working overtime, and that's why he was calling so late.

Is it Chase or a collection agency calling for Chase? I think only collection agencies have to play by those rules.

And if their time reports that it is 8 am in your time zone as long as their computer logs it and it is believable then a cpmplaint won't really do anything at all.

If i's Chase themselves (operating under Chase's own name) it is technically legal for them to call at any time. Only collection agencies, or in house collections department operating under a name which is different than the creditors are governed by the fdcpa.

Chase will tell you they voluntarily adhere to the FDCPA, but since they are not required to there is no grounds for violation penalties.
