I hope that you are a good attorney. I tried to find a license for you in Pennsylvania to no avail. Mr. Mitchell with your company contacted me Friday(6-16-06) at work and was willing to set-up payment arrangements at $100 for the next 4 pay dates when I inquired about the debit coming out of my account that day, He put me on hold and
said he spoke to Mrs. Kennard and they debited my account for the whole $500.00
the asked if it was going the debit my account 10 times.

I believe this was a blatant attempt to extort more money from me, if I would have agreed to the payment plan without question you would have taken more money for the payment plan, the 10 debits is clearly a phishing scheme to see how much money I had , and then you would have been able to charge NSF'S . Clearly an extortion attempt.

Mr. Mitchell stated that I void my contract because I asked for a payment plan. I don't think this signifies a reason to void a contract I was will to pay the money.I think your company preys on desperation and there is not a good thing for society

I am going to pursue this to the full extent of the law.Meaning arbitration and the A.G. of Oklahoma.Mr. Williams I am not going to bore you with the Oklahoma statutes on deferred lending, I am sure the A.G. of Oklahoma will t since your were kind enough to give me your contact info to pass-a-long to him, BUT I WOULD LIKE TO POINT OUT ONE STATUTE, NOW READ CAREFULLY!!!!
This is Oklahoma statutes title 59 chapter 47 § 3103 - Scope of Actiled complaint with state


THE REST OF THE EMAIL:
The scope of this act shall not apply to a supervised lender licensed under the Uniform Consumer Credit Code. Further, nothing in this act shall modify, affect, alter, change or restrict practices or operations of supervised lenders under the Uniform Consumer Credit Code, rules of the Oklahoma Department of Consumer Credit or rules or interpretations of the Administrator of the Department of Consumer Credit.
Except as otherwise provided in subsection A of this section, the provisions of this act shall apply to all deferred deposit loans made; provided, the following lenders shall not be subject to the licensing requirements of this act:

A bank, savings institution, credit union or farm credit system organized under and regulated by the laws of the United States or any state;
Government or governmental agencies or instrumentalities; or
Pawnbrokers engaged in pawn transactions as defined in the Oklahoma Pawnshop Act.
The provisions of this act shall apply to transactions if the lender, wherever located, enters into the transaction with the debtor by mail, brochure, telephone, print, radio, television, Internet, or any other means.
Now you say I fall under New Mexico Law, well guess what you fall under Oklahoma Law.
I would also like to point out another case.
Thompson v. Handa-Lopez, Inc., 998 F. Supp. 738, 744 (W.D. Tex. 1998)

What can I do. I tried to set up a payment plan, Lynn refused and now faxing my personal information across the fax at my job. I am in Texas. Please help.

they will set-up a payment plan you just have to be agressive. I would send the letter for them to stop drafting your bank account and talk to the bank to make sure you have an agreement with the bank. Also in the letter demand the only contact is through email or postal that way you have record.

i am also in texas and having rproblems with this company. What can I do besides refuse to pay anymore. I have already paid $710 on a $300 loan. not to mention the fees for the ACH returns they did on Friday. 5 in one day. After I told them I was not paying anymore. Can they do anything to me in Texas.... I have looked for information on the langhorne law in langhorn penn. and can't find anything on that.
