I am being taken to court by Asset Acceptance for old Providian card

All of you dealing with Asset Acceptance LLC have my sincere respect. I go to a pre-trial conference with attorney's from Asset on Monday August 1, 2005. Unfortunately I forgot to request a jury trial in my answer so that's not an option. I defaulted on a credit card with Providian in 12/2000. I did phone Providian twice in 2001 to attempt to make payments but was refused both times, the last time I was told they were taking me to court. This never occurred. I later received a settlement letter from Asset who had aquired the credit card account from Providian. They offered me a buy out deal. I called to try to make payment arrangements because I didn't have the kind of money they were asking for the buy out. They informed me that they had some kind of financial statement of my earnings and they were well aware that I could afford it. I probably could afford it if they were the only bill I had to pay. So, were going to court. Unfortunately, they have a very high court success record in Arizona. We are also going to be having our case heard in a small justice court in Glendale Arizona which is well known for being pro-business. Wish me well and good luck to all of you.

this company operates outside the law every single day. they re-age accounts to make them look collectible. they lie. they steal. when sent a cease and desist letter, they ignore it. if there was a way to file a class action suit against these slimeballs, i would certainly be interested.

Welcome to the forums. It is sad that the illegal activities conducted by asset acceptance llc are increasing each single day.

You can exercise your consumer rights by suing them in a state or a Federal court within one year from the date the law was violated. You can recover all the damages charges on your win and an additional amount of $1000 and also the court and the attorney costs.

You can file complaints against them at the state Attorney General office and the FTC at their toll free 1-877-FTC-HELP (1-877-382-4357); TTY: 1-866-653-4261.

Is there a way to find out if they have a specific toll free number that they use to call people, and do they outsource their agents? I started getting calls from them three years ago for some male that I do not even know. I told them repeatedly that they have the wrong number. Some of the calls were irritated people breathing angrily into the phone and shuffling their papers...I have caller id so I know it was them. Finally they stopped calling, then several months later, the calls started again, from a different number and no identification on the caller ID. They also have never identified themself. I again told them they have the wrong number finally yelling at the rep to take my number off their list. Time passed, the calls started up again, same senario. Now the calls are coming from 00 877 etc, or +877 etc. Nobody would be there when I picked up the phone, finally somebody was there, asked for this person, I demanded to know who they were and what this was about. The guy mumbled some name and then said he was with the "junior police academy", which is a lie. I laid into him and told him he had the wrong number, this has been going on for three years and to take my number off their list. He kept demanding my name which I refused to give. Then he finally said okay and hung up. One day passed then now the calls are coming again. I would like to determine if this is Asset Acceptance oursourcing because they are the initial caller and apparently have never taken my number off the list. Any help would be appreciated. Oh, I did contact the police dept, the cellular company (fwd calls to the cell) and the landline people but nobody can help me out. Thank you!
