I spoke with zwicker and ass.
I spoke with zwicker and ass. earlier this year, agreed to a settlement and wasnt able to pay it b/c of money problems that came about in my home. someone from zwicker called and told me that my account is up for litigations and that i would have to pay atty. fees and that they would start taking money from my husbands paycheck since i wasnt working.can they do that? im still not working and now i dont know what to do..please help
With my experience with credit card collectors, a judgement must be presented to an court before wage garnishments can be procured. You must understand that by law a collections agency must file a complaint with a court, before a judgement is rendered. My educated guess is that the collector and/or creditor want to provoke you to provide payment. Nonetheless, depending upon what state you reside in, it is against the law to propose actions regarding salary garnishments. Stay informed. |

Welcome to forums. Collection agency cannot contact your spouse if you do not give them your consent. They cannot disclose your debt information to others including your spouse.
There are certain guidelines which a collection agency needs to follow. They cannot use abusive language, cannot threat you and so on. If they do that you can file complaints against them. You can hire an attorney too to deal with them.
Also they can't deduct money from your husband's paycheck as this is not permissible by the law. So don't worry, get in touch with a capable attorney and take legal help from him regarding this matter.
