auto repo debt statue of limitations in NC

My auto was repoed in North Carolina. I have since moved twice - FL and now CA. What is the statue of limitations on the debt?

Welcome to the forums

Your auto is repoed in North Carolina and now you are presently residing in California. The SOL of North Carolina in case of a written contract is 3 years an in California it is 4 years.

The creditors have the sole discretion to select the state in order to apply the SOL. Since the SOL of California is longer than North Carolina hence it is usual that the creditors will choose the SOL of California. This is because they will get more time to sue you and take you to the court.

My truck was repoed after I had deployed to Korea while stationed in FT Bragg, NC. My ex did not pay on it, therefore, it became a voluntary repo. I had since come back and been deployed over sea's a few times and never really thought of my responsibilities to the truck. Now, I pulled up my credit report and KNOW I still owe a small charge, however, I have no idea on how to contact them, any advise???

The statutes of limitation depend upon the type of debt and the debt collection codes in your state. Almost, all unsecured debts are out of the SOL period between 3 to 6 years from the date of last activity in your credit card account.

Please tell us the name of the state where your credit card account was opened. Based on the laws in each state, you can be told about the applicable SOL period.

Remember, statute of limitation is renewed every time a payment is made towards the account. It even gets restarted if you sign a promissory note to pay the debt amount.

Verify the details of the debt and the SOL period of the state in which the account was opened before taking any further actions towards it.

I was checking this out for my dad. He is in a nursing facility. The facitility tried to schedule an appointment for him but the Neourological Office would not make an appointment because he had an outstanding bill from 1999. Has he reached the statue of limitation and does not have to pay this bill. Can they not accept him? Should I mention about the SOL to them?

Do you know the date of last payment towards this account? For considering SOL, you need to have two important information:


  • The date of last payment activity on this account.

  • The name of the State where this account was originally opened.

Check the laws of SOL in your state and see if it's out of the statutes. You are not required to pay anything if there has been no payment within the SOL period. You will have to notify the company in writing about the expiry of the statutes. Have everything documented for future use.

My vehicle was repossessed in Missouri approximately seven years ago. The last payment was prior to that. The collection agency is still trying to collect on this debt. Has SOL expired?

Hi,

I am trying to help my boyfriend. He co-signed a car loan for his former girlfriend's daughter (aged 22). She decided to not pay the loan and they repo-ed her car. She has now skipped out on the debt, but they contacted him. Unfortunately, he had just gotten hurt on my job and was on disability and broke up with the mom, but did cooperate with the collector by providing all the contact information for this woman. After cooperating with the agency, they seemed to stop contacting him...Well, they must have sold the debt because NCB Management Services just contacted him about paying the money (about 6K). We are not sure what to do...We have her contatc info, we doubt she will pay the bill now. Is there anything we can do to minimize his liability...

Learned a painful lesson about co-signing loans

I LIVED IN P.A. MOVED TO N.C. I BOUGHT THE CAR WHILE I WAS LIVING IN P.A. MOVED TO N.C. IN JULY OF 2004. THE LAST PAYMENT WAS MADE IN AUGUST OF 2004. IT WAS REPOED IN SEPT. OF 2004. TOLD THEM TO COME AND GET CAR BUT THEY CAME IN THE MIDDLE OF NIGHT AND TOOK THE CAR. IT HAS BEEN 3 AND 1/2 YEARS. DOES THE STATUE OF LIMITATION APPLY HERE.

I have pretty much the same question too... My husband had a car Voluntarily Repossessed 7 YEARS ago since he got in a horrible accident 4 months after he purchased the car.... The last he knew they came & got it, that was it, no paperwork or letters or anything...

Then, 9 months ago we received a call telling him that he owed over $8,000 for that reposessed car!!! He told them that that was 6 YEARS ago (at that time) and that if he had known he owed anything he would have paid on it back then! Now about half of that is finance & late charges!!!

So, he told BB&T to send him proof that they had filed a judgement against him (since we weren't sure what to think)... And nothing ever came!!!! NOTHING at all, until yesterday! (Which is now 9 months after first learning he had a judgement against him)

So, my question is this, isnt' the Statute of Limitations up after 7 years??? And also, shouldn't it be disqualified since he wasn't sued right after it happened???

I bought a car from a buy here pay here company in Jan 09 and moved to Alabama in March 09. My last payment was made in April 09 as I lost one source of income. The company states they would repo car and I settled in with that expectation of pickup. It has not been picked up or paid on since then. I do maintain insurance and keep the car in good condition but dont know what to do as I have not heard from them since then. My telephone number has changed but address has not in over a year. Can they still repo or past some type of SOL since then?

Car and motorbike insurance coverage will not be some what exciting. Based on which inturn express your house is through, it may possibly well always be an important smaller in addition to big little bit of your capacity to pay rather than other people around status outlines. What is the minimum amount for the state? I've noted this web site very useful to evaluate low cost auto insurance. I'm sure thrilled to be here.
