Hello,

There is a debt on my husband's social security number at America Agency. This debt was dated since October 1995(Pacific Bells Phone company). And there were also one from December 2003(SBC phone company) Today my husband attempted to open an account at SBC phone company and the collection agency told us that we have to pay them full amount otherwise they will notify SBC that there is still one debt left in there record even if my husband pay the SBC's debt.
I wonder if they have right to keep the record of Pacific Bells and notify SBC?

Coming to your query, the collection agency cannot force you to make payments on a particular debt appearing in your credit report out of the lines of the fdcpa law. They need to provide you the accurate picture of your debt amount furnishing the details of your creditors and the agreement letter that you have 30 days to dispute the debt if you disagree with the contents.

If you dispute the debt, the collection agency has to conduct an investigation on the portion of the dispute and is required to notify you about the change.

Please ask them to send a debt validation letter before you are willing to make any payments to your debt. Your validation letter will include the following details to be furnished:


  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

If the creditor has sold the debt to the collection agency, then you will have to make payment arrangements with the collection agency as the creditor is no more involved in your debt.

You can take the professional help of the consultants working in the debt consolidation program to negotiate with your debt collectors. He will skillfully deal with your collectors keeping your interests protected and ensure that your money is deposited in your debt account only.
