Hi--me again! I had an account with home depot that charged off. It never went to a collection agency but for the past few months, I have been sending them a payment every month. I have still yet to hear from them. Before last month, I sent money orders but decided to start sending checks so that I could see that they were cashed. well, after sending a check to them last month, its still yet to be cashed. so now, I'm not even sure whats happened with the past money orders that I've sent. I also have another account that is doing the same way with another company (wells fargo)-only they went to a collection agency and the collection agency is doing this very same thing. no correspondence, no check cashing. so, now what? they've yet to answer any of my letters. (home depot or wells fargo CA). now its about time to mail out another payment for this month, what should I do? thanks much! shirley

Hi Shirley

Before sending any payment, consider sending them a payment agreement letter. If they respond, you will get confirmed that your money is getting deposited in the required place. Please alter this letter according to your requirement.

RE: Your {letter dated} or {phone call on date} reference account #: {place account or reference number here}

Dear Mr. /Ms. {Collector's Name}

According to my records and your {phone call or letter} the balance of this debt is $_____. I am not disputing this debt however; my current financial situation prohibits me from paying the amount you're demanding. I am able to make payments on this account every {insert date of month} to your company in the amount of $ _________.

I would appreciate a call from you confirming your acceptance of my payment terms. However, if I do not hear from you, I will consider your cashing or depositing my check as confirmation that you accept my payment terms. If you do not accept my terms then I expect the enclosed payment to be returned to me immediately in the enclosed self-addressed stamped envelop.

As a show of good faith I've enclosed my first payment in the amount of $________. If my financial situation improves enough for me to increase my payment amount I will contact you immediately. Thank you for understanding.

Sincerely,

Signature
Your Printed Name

Thanks Roxette, but I have done this. I have sent this letter to all of my creditors/collection agencies. everyone has responded except for these two. And up until last month when I mailed them a check, I thought they were cashing my money orders. now I'm not so sure. They haven't confirmed acceptance, haven't cashed my checks to back me up on saying that if they cash the checks, its confirmation that they accept my payment terms---and haven't sent my checks back to me. They don't answer any of my letters and I have wrote tons and tons--nada, nothing. (have them all saved). I'm wondering if I should just stop all payment and correspondence until I hear from them???? I really don't know what to do at this point. usually you don't have to beg these people to talk to you...you have to beg them NOT TO. thanks! shirley

Shirley

Please check if these companies are doing business or not. You can contact the customer care cell of home depot and make sure if they are existent.

Regarding the collection agency, I guess the debt might have been passed to a different collection agency. Did you check the latest credit report and know the latest standing of these two accounts. Also, you need to check out if the account in collection agency is shown as "Charged off" or not.

like most rebate companies, and others that send you compensation checks, write under the date in red pen void after 90 days.

make a copy (both sides) and any paper work you send in ...

this should be with any company you conduct busines with. 90 days is plenty of time.. wayyyyy too long in my opinion.

also when they say they will accept post dated checks, this is a ploy to get you to send in money early.

it is illegal to post date a check, and they will cash it like it was dated yesterday. or hit your account with NSFs.
