I received 2 phones within 5 mins of each other from a Ms. Hawthorne from Ellis Crosby and she told me affidavits would be filed today at 3 pm if I didn't pay the $230.00. She said they would be filed in my county and I would go to jail for fraud. I tried to tell her I couldn't make the payment today and she said too bad see you in jail. What should I do?

Ellis Crosby is under suspension due to its unfair means of debt collection and should not continue with collection activities during this period.

fdcpa has defined a set of instructions for collection agencies, violation of which may cause serious punishment. No collection agency can threaten you saying that you would go to jail if you don't pay the amount. They cannot call you repeatedly, if you feel disturbed.

What should I do about making a payment. I do owe this debt, however, I do not have the full amount at this time and I was told by Ellis Crosby that if it wasn't received in their office by 5 pm Sunday that an affidavit would be filed against me for fraud and theft and I would be arrested and served papers upon.
