I need help. Today my wages were garnished. According to my employer they were garnished by an apartment complex that I lived in 10 years ago. I have never been notified that I owe this amount and never notified that I was being taken to court for garnishments. What can I do to have this corrected? Not only has this been 10 years but I was never notified that this was going to happen. Is there a statute of limitations on something like this. This is an apartment that I moved out of in 1994 and I was never notified that I owe anything. What can I do?

Welcome to the forums. The creditors should produce a court order before your wages get garnished. If it has not been done, then you should consult your attorney for this purpose.

Moreover, your debt is past the Statute of Limitation period. Also, 7 years reporting time for this debt is also over. At this point of time, it should automatically get removed from your credit report. Please pull your latest credit report from the three credit bureaus and confirm the latest standing of this account.

The creditors or collection agency cannot force you to pay the debt after you confirm the latest standing of this account in your credit report from the three bureaus.

My wages have been garnished due to medical bills. I am the only source of income for a family of four. The garnishment is hurting. Is there any way to get the amount garnished lowered? It is causing severe financial problems.

Calradio, before this garnishment took place, did you receive the court orders? If not, then this garnishment cannot be considered legal.

If this garnishment has taken place legally, then the creditors can only make arrangements to lower it. A proper negotiation with them will solve this matter.

I never recieved any court order papers regarding my wages being garnished by a creditor. And I believe the debt is 8 years old too. I just recieved a letter from my current employer that my wages were being garnished. Also, I believe I am paying about 2000 dollars in intrest from the original debt. This debt is owed from a over paid unemployment claim from Washington State. I completly forgot that this account still existed as I have not recieved a bill from them in 2 years.
Is there anyway of stopping the garnishment and going on payments with the creditor? The creditor wants 25% of my income, according to Arizona state law where I currently reside.
Also, is there any free legal advise to help me with this. The garnishment is set to happen on the 9th of Sept 2005 and I just got the letter today Sept 6th, from my employer.

i think it is wrong that your wages got took like that and it is so hard these days to get what is rightfully yours back i think you should try to get a lawyer.

Landrew in the field that I am in, I see this happen all the time. Since it seems as if the government is garnishing your wages, they are not required to have a court order. Most of the time on this type of garnishment, the employer receives the notice to withhold wages and they are required to present you with a copy. You should try contacting Washington State to see if there is any type of payment arrangement that you can make with them. Be aware, that they also have the right to put a lien on your state income tax return (if applicable). I would definitely contact Washington State. I have seen that most government agencies are willing to accept arrangements in leiu of garnishing the wages. I hope this helps.

Hello. I have been told by a collection agency that their attorneys are going to garnish my wages if i dont pay in full. I have not recieved any information about garnishing anything. Can they do this? Also, the debt is 10 yrs old. Thanks

Hi Bobby,

Garnishments can take place only after you have been served a notice and you will be asked to appear in the court. To confirm if there is any judgment against you, you can check your local registrar office and the latest copy of your credit report.

Your debt seems to be out of the SOL period and 7 years reporting period. This prohibits any legal actions against you and you can also get this account removed if it is shown in your credit file.

I like most was surprised to see my wages garnished. I fought this and the ruling was overturned, however my employer is still garnishing my wages even though I have a signed judgement overturning the original court order. What do I have to do submit this document to my employer?

I have an nine year old dept that has come to haunt me. It is no longer on my credit reports. My son's disability check was completely garnished back in 2004. I've heard that was illegal.Iam just getting back on my feet from bad dept decisions. I am working now and I just received a notice of garnishment. Did that garnishment from 2004 extend the SOL. Can I get this overturned?
