Have anyone dealt with this company. They say a lot of things like ECS does.

Sounds like another one of the many scam artist companies...I have a feeling all of them are in the same "ring." I haven't dealt with them personally, but if they're saying the same things as the other companies are, then they're just as shady. Unless they can validate your debt and it's reasonable, don't pay them! And if you do send them any money, make sure it's via moneygram! Can't trust these companies these days....

I dealt with this company before a couple of years ago. They threatened to come to my job and left threatening messages on my cell phone. Luckily my cousin's boyfriend worked at an attorney's office. I told them to speak with my attorney. I even told them that all calls from that point on would be recorded because they had no right to talk to me that way. Needless to say, I never heard from them again:)

Rhonda, you called them a couple of years ago and you sounded so confident at that time. Imagine, if now they call you up, they will make it a point not to call you back and feel scared. You are so well informed. :D good job. I suggest all to get educated. It's the best way to tackle any kind of complex situations.

A guy from this company called and left such an ambiguous message including a phone number that consisted of 3 too many digits, PLUS an extension that at first I thought it was a joke. My 6 year old son has better phone skills and sounds more professional than this idiot. Luckily we have caller ID and tracked the number back to this company. What bothered my wife and I so much was that we went thru a bankruptcy (I was downsized and out of work for 14 months) over 18 months ago and only have loans which are current. I've taken the liberty of recording the message and delivering a copy of it to my attorney for further legal action. Having also been the victim of identity theft (minor damage and also taken care of) I am VERY protective of who has information about me and I am going to go after these losers tooth and nail. They picked the WRONG person to try to scam.

I just got a call from them and they told me the same thing that Ellis Crosby & Associates told me. They said that I had until Friday to pay $800 for bank fraud and they said that if I didn't pay by friday, they would issue an arrest warrant with my local authorities. Is this legal? How can they do this and what should I call them back and tell them? Someone please help me!!

This is definitely not a legal way to handle the debt accounts. There are many companies that want to pocket your hard earned money and these scary tactics are one of the ways to fear you.

You won't have any arrest warrant against you until they have proven your debt. I am pretty sure that they won't be able to do so.

Read this forum thoroughly to know more about their illegal practices and handle the situation strongly. You just don't need to get fearful. Everything will be fine.

One more thing, file your complaints against them at the FTC, BBB and the state attorney general office.

Ben- thank you for the encouraging words. I still don't understand what I should do though, I called this Henry Jay and asked him what his address was and he truely had no problem in giving it to me, which is what Ellis crosby & associates did. But, I can't find a Better Business Report on them at all. what should I do next?

Get their mailing address and send a debt validation letter. State in that letter that until the debt validation letter is sent to you, telephone calls will not be permitted as per the fdcpa law.

Once they can validate the debt in legal terms, you might think of paying it off. Basically, they are required to provide you the following information as posted by Roxette

  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

Till the debt is validated, you just don't need to worry at all.

I just got another phone call and the guy told me that because it is a bounced check issue, that they didn't need to validate the debt, all they needed to do is let me know 10 days in advance of the legal things they intend to do. So he told me I had until today to get this straightened out and they would proceed legally, please help me I am really scared now!

Henry Jay called me today. After my experience with them prior and my expereince with Ellis and Assoc, I did not feel scared. I know an attorney and he told me that they cannot come and arrest you on the spot like that. You have to be notified in writing by cerified mail for a request for payment before it is sent to court. I asked him for copies of the complaint, he told me he does not have to give me anything. Which is not true. He got an attitude and i told him my attorney will contact him tomorrow. He called me at 4 pm on Monday and wants 600.00 by Wed morning. I wonder if he wil call back.

Hey hottanya!!

Are you really scared by their blank threatening? :D

Trust me, nothing will happen to you. You still send them a debt validation letter and be sure to send it certified. This will prove your side of the story in a powerful way that you are willing to pay it.

Also, you can record all the telephonic conversations and inform them about this activity. Most probably, they will stop further calling you.

If the debt is legitimate, you are ready to pay. But you are expecting something in written before you pay. Isn't it? And that is what they are not able to provide. If necessary, you can take legal help also.

Regards
Roxette

So yesterday after the Henry Jay guy from A.S & Associates called me, I went down to the legal aide office and got an attorney to help me with this situation. The attorney said that any debt collector has to give you written notice of the debt within 5 days of contacting you. The Henry jay guy told me he wasn't going to waste his time sending documents to me. I also told him I knew it was a crime to threaten me that someone would be coming for me with an arrest warrant and he denied the claim all together. I need some help here, the attorney said that sometimes these debts get passed around so much that the collection agencies can't validate the debt and you don't have to pay until they do. Need advice desperately, someone please help me.

I paid this company money about a month ago. I gave them $535 and they said I was free and clear. The only thing I show on my credit report owing is one pay day loan $490 and wonder if this is really what I already had paid off.

How do I find out what they want? I don't want to call them and tell them I have no money until the end of the month.

I am so frustrated by all of this. I am trying to work things out with the payday loans that I have out there.

Does any one know who they deal with?

Which payday loan places?

garnerjl, A.S. & Associates deals with USAdvance, they claim that USAdvance borrows the money from a company called Pan American to give to you and they claim they are recovering the money for Pan American, but the payday loan company should be USAdvance.com

Yes, I paid that USA Advance or Panamerican so how can he be calling saying another situation has arisen when I already have the paperwork stating that I paid $535 in one lump sum within 2 days to take care of the debt. Right now I have no money to send to him. My rent was due out of my last paycheck and it pretty much eats the entire paycheck. I am a single mom of 2 young children and a 20 year old who is not taking care of herself yet financially.

I just want to make sure that they cannot come arrest me because I cannot lose my children over this. Henry J. or whatever his name is threaten me with the police and a judgement with the courts. I do not see this on my credit report.

Will I be OK if I just wait to see if he contacts me again and what he says. He called about 1:30 p.m. on Friday and I am leaving my work at 2 p.m. today because of a Drs. Appt. I don't want my work place to be hassled.

Thanks for your advice and assistance!
