I just received a phone call yesterday at my father's residence ( where I haven't lived for 4 years) and when I called back I was given the routine of , any warrants for my arrest?...am I on probation?...we are filing a warrant for your arrest...so on and so forth. I HAD taken out some payday loans out 6-7 months ago and thought that they were all taken care of. So, a month a go I closed out that checking account. They are now claiming that I am embezzeling money and internet fraud! The fact that I quit my old job two months almost three ago isn't helping either. THey are claiming that I am trying to SCREW everyone out of their money. I called the Sherrifs dept, police dept, civil courts and The attorney generals office yesterday after getting off of the phone with them TERRIFIED! There is no warrant, they are bullies. I called back this morning and said that if I owe money, I have NO problem paying it, but I wanted invoices, original applications, payments that were automatically taken out of my account, and it on their letterhead with their added fee separate. They are providing me NO proof. Do I think that this is legite? No...Plus they are telling me that they don't even want me to pay it anymore and that they want to take me to court. I said Fine...my best girl friend works at the attorney generals office here in minnesota and she has already gotten a phone call from me. Plus the local police department have their phone number for harassing phone calls and have attempted to call them themselves. UGH....any suggestions?


Hi Ally,

The best part that I like in you is that you did not get intimidated by their call and returned them back with what is said to be legitimate. If Ellis is really asking for some money, then they need to provide the complete paperwork including the invoices, original applications, etc.

I am sure they don't have these papers to provide you and instead want to scare by taking the matter to the court. You again fought well saying about your best girl friend working in the government office and other complaints lodged at the local police department. I am sure they won't make the mistake to contact you back again.

That's the spirit. Be tough to such jerks.

I was scared and intimidated by their call until I told my fiance what happened and he started asking all kinds of questions, who are they? Who are the creditors? What proof do they have? And then realizing that they wouldn't give me any of that information, he then told me what was really going on. After speaking (YELLING) at each other over the phone this morning, I realized that this is totally not legit because if it was, why wouldn't they provide me the info that I was looking for so I can pay it off but instead wanting to take me to court? The whole story is that I did take payday loans out when I was at my last job, using my email address that I had for work. I since left that job, started my own company and closed the checking account out last month. To anyone else, yes that probably looks like I was running, but why would I call them back and tell that that I am willing to pay if I owe the money...???? UGH. After getting off the phone with them this morning and being SO PISSED that I started looking on the internet and found this website. THen I knew it was all a bunch of crap. Now I am getting even. My girlfriend has this info and Tuesday morning, a complaint will be lodged. They wouldn't give me their license number when she told me to get it because they have to abid by Minnesota state law with collecting and it is against the law to threaten to have a warrant issued for your arrest. They will get what they deserve and they will regret the day that they ever left a message for me. I am more furious after reading these poor peoples experiences! I am actually a very sweet person and I am so glad that I talked to my fiance about it because I told Ellis that I could pay them next week. How do (he mentioned only 2) 2 payday loans total $1697? Baffling....Thanks for the reply. Give me any advice and knowledge so I further know what I am talking about. THanks

Hi Ally

Welcome to the forums. You are moving absolutely in the right direction. Moreover, since Ellis Crosby has been suspended and a lawsuit is filed against them by the attorney general of Florida, you don't have to take them seriously in anyway.

Though, I assume that they will not bother you, but if they call you then inform them that you are recording all the telephonic conversation and will present it to your lawyer.

Also, you can ask them to provide the following information with complete details. This is your legal right to know the complete validity of the debt as per the fdcpa law


  • The details of the account.

  • All the calculation should be shown of the amount that is owed.

  • Any copies of the papers to be furnished that shows the payment agreement.

  • Provide a verification or copy of any judgment if applicable

  • The original creditor needs to be identified.

  • The Statute of Limitation needs to be proven for the collection of the debt.

  • The license of the collection agency applicable in the state is to be furnished along with the license numbers and Registered Agent

  • Proof of the agreement that the debt collector has purchased the debt or has been hired by the creditor to collect the debt from the debtor as this is the basic contract law.

  • Complete payment history showing the details of the creditors, payment history, amount of the debt, break up of fees/interest should be provided in paper.

  • A copy of the original signed loan agreement between the debtor and the original creditor establishing the debt between both the parties also has to be produced.

I have heard that if you send money it doesn't even go to your debt. I will type up a letter with Roxette's criteria and send it certified mail. Does that seem to be the best since you will have record of sending it and someone receiving it? How long should I wait to hear back from them? I just want to find out if I do honestly owe money and if I do, pay it and if I don't quite worrying about it. Also, do they have the ability to put negative marks on your credit? Thanks for everyone's advice and input!

Ally, if you do all your correspondence through certified mail with return receipt requested, you will have a written record that it has been received by the collection agency. In this way, it will prove your side of the story.

As long as you are willing to pay your debt, your credit report will show positive remarks and you will not have to worry about it.

Yes, they have the right to put negative remarks in your credit report if it is legitimate. If you find any information in your credit report to be incorrect, you have the right to dispute it. They will have to provide explanation for every remark disputed.
