single mom..they are threatning to arrest me..what do i do?

:? Has anyone else been recieving phone calls from "Free Litigations of America"?..904-356-0886 or 904-356-0927?I recieved a messege from L.T.Wineburg..he called my aunts cell phone and proceeded to tell her his business with me and that a warrant had been issued for my arrest for stealing federal money.in regards to a payday loan from get cash 911...he also told her my social security number,my drivers license #,and my bank account #...of course half of these weren't correct but still,isn't it illegal for ANYONE to give out personal info like that?....Ever since i found this website,i am feeling a little safer and sure that i'm not going to jail,but it has caused me a lot of grief...my aunt and uncle (which whome they contacted and told everything to) believes them and is threatning to take my 2 yr old son away from me...even L.T Wineburg said they would have him taken from me..and they accused me of being on drugs...i swear it was like jaw dropping stuff...i felt like i was in the twilight zone or something...PLEASE tell me they can't arrest me..i am soooo scared at this point...i'm only 23...a single mom...barely getting by...i can't deal with jail...i don't wat to lose my son...please help!!!!what are my options?..what do i do?....


Sounds like a big stinky pile of B.S. to me! The tactics they are using are illegal. If you want to know if there is a warrant for your arrest, all you have to do is call your local law enforcement agency.

There are others here that are much more knowledgable about how to file a complaint. But, it sounds like you have a valid case against these jokers! You need to contact the Florida Attorney General.

I cannot believe they threatened to take your child! That is insane!

i know!like i said,it was like something out of the twilight zone..lol..i just recently resolved all my debt issues,and things were actually looking up and under control,then this happened and totally set back my frame of mind!But i have already filed my complaints with the BBB and attorney general,after reading more on this site..i also called them back and left a messege(suprise,voicemail..lol..)and told them that i was aware of the fact that they were indeed ellis and assc.,operating under a different name,that i had in fact contacted an attorney,and thanked them for scaring me enough to do so without which i wouldn't have uncovered this site and all its helpful info..lol..i bet they get a kick out of that!!.. :lol:

If you receive a call from Ellis, Crosby and Associates in Jacksonville FL, 904-356-0927. Do not let them scare you. This is a collection agency and they are under investigation by the Flordia Attorney Generals Office.

WOW i just recieved a call from this number you mentioned.904 356 0886..WHAT a WITCH SHELLY LONG is.. She preceeded to tell me she wanted to talk to ME or MY ATTORNEY..lol like MY ATTORNEY would be answewring my cell phone..I asked what this was in reference to and she said a legal matter, and there was federal laws protecting me.I have no clue as to what this is about.I have noticed this number on both my cell and home number.Funny tho, SHELLY LONG will block the number from my cell, but not my home.
This has really worried me especially after just talking to her SMART A$$$..I told my daughter and she found this site, and after reading your post I too feel some what better.However, I am NOT in florida but texas.does the same apply for me here as in florida?? This is all I need to do is worry about this.
SO SHELLY LONG,along with L.T.Wineburg really know how to THREATEN & SCARE people. :evil:
Please IF ANY ONE can advise me I would appreciate it very much.Looking forward to your replies.

Under Federal Law you cannot be arrested for being in debt.

You can read the Fair Debt Collection Practices act at :

It is important to remember these laws do not make your debts go away. You are still responsible for them , however these laws are there to protect consumers from abusinve anf fraudulent practices by consumers.

Hi Boo

Welcome to the forums.

As per the fdcpa laws, the collection agency will send you the account details in writing after they have placed the call to you.

If you don't get anything in writing, you need to place a request for debt validation at the company's mailing address. This will help you to get an accurate picture of your debt account and also help you in making the payments. Remember, after you have paid the account, your credit report will be showing the account as paid. So, you need to negotiate with the CA keeping your credit ratings in picture.

ty clay and roxette for the info.i did do some calling today and the company never answered the phone.umm!! so then i contacted the AG in fla.i read the inquiry regarding the company.to be honest if i knew what i owed i would like to get this cleared up. ty for ur help.keep up the gr8 site, very informative..

Although chances are very rare, but you might get some help from your creditors regarding this account.

Send a DV letter to the collection agency in writing. They are required to respond you within a reasonable period of time. If they continue to call without giving you the validation details, you can take legal help. Look for a lawyer who specializes in the lawsuits of fdcpa and FCRA violations. He will help you in filing a case against the collection agency on violations of consumer protection act.

So Erwin.m Koch and Mrs Long I spoke with . buth using threating conversation to demand payment, saying I will be criminally prosecuted in my state of Colorado for this defaulted payday loan. It freeked me out at first into seeing what payment options I could make. He was telling me he went to harvard and was an attorney representing EP process. I called back wanting a letter or fax sent or verification with the company they said they won't stamps or send info on me. I told them why couldn't I just directly contact company or send MO. they siad they don't accecpt payments but that they do Moneygram transactions. What a big joke they all most scared me into actually sending money to this company stating they would contact my employer. He went as far as to tell me after about 5 minutes into the converstion "Oh by the wasy I'm recording all info we've talked about" I advised him thas aginst the law your suppose to tell me prior to conversatiom. He said had I read the details og the contract I would know have know rights and that if I don't pay I will be criminally prosecuted due to the new Martha Stewart laws. I'm completly scared where do I go ? I feel uncomfortable sending money to them so I'm trying to locate more info on this loan that needs ot be taken care of. Please help
