I need help with collection agnecy
I am being severally harrassed by Accounts Receivable Tech and today was the worst. I have asked 3 times to have the debt validated and still no response and sent a debt validation letter certified mail which they received on Oct. 14. Today Fran called and was extremely rude when I asked for validation of the debt and why they are asking more than they owe? Her response was I will send a letter. I have yet to receive a letter from them, just phone calls. Fran had the nerve to tell me that we were deatbeats avoiding our bills and we threw their letters away. I told her that it seems awlful funny that I send a certified letter on the 11th of Oct. and they receive it the 14th of Oct and the supposed 1st letter was sent from them on the 28th of Sept and the 11th of Oct and haven't received either one. Doesn't a collection agency have to verify information requested? Especially when they bought the account from Ellis Crosby & Associates? I am at my wits end and can't take much more. My husband was a victim of ID theft in July and ended up with payday loan nightmare. The other 3 places have set up reasonable payments and had no problem validatingthe debt. Please help me in any way of advise on how to handle this situation.
Thank you for your time
Hi mom of twins I wish that working with Accounts Receivable
Hi mom of twins
I wish that working with Accounts Receivable would also have been smooth just like the other 3 places you are dealing with.
If this collection agency is not validating the debt in spite of your repeated validation request, it seems that they are not holding your debt legally. They are forcing you to pay on something that is unknown to you. At this situation, you should write a letter to them stating that they have failed to validate the debt after repeated requests. Thus, they are required to remove any negative remarks put on your credit file. After requesting for validation, if they have not given you sufficient information about your debt, and if they are reporting to the credit bureaus besides calling you endlessly, all these activities result violation of the federal laws and you are required to take legal actions against them. Hire an attorney that specializes in the lawsuits of fdcpa and FCRA violations.
I hope that you will be able to end this problem with the help of your attorney.
