Can a payday loan establishment withdraw money earlier than the day stated in your loan agreement? I took out a loan with Platinum B. Services and agreed repayment on 12/23/2005 but the loan amount (minus fees) was drafted on 12/16/2005 which caused my car payment not to clear the bank. I was then charged a fee by the bank for a returned fee because the car finicial place and also anmother bill ateempted to withdraw money that would have been there if Platinum B. Services wouldn't have touched my account until the agreed date. Platinum B. Servises is now wanting more money......what should I do? I am thinking of doing a stop payment. Please give me some advice!!!!!

You need to consult your attorney in this matter because it has resulted a breach of contract. The attorney will give the options to the lender on how to settle the matter or if required, the matter will be taken to the court. You can also resolve this dispute by other legal methods that might be more cost effective than to simply file a lawsuit and get the matter settled in the court.

In the legal process, the attorney will file for the compensatory damages from the company. The amount of damage has to be reimbursed by the company including the attorney fees and other court costs.

Don't make any dealing with Platinum B without consulting your attorney. After the matter is settled, you can likely get this agreement reformed.
