Ok I actually have 2 questions here.
1) I have been getting the collection calls at work. Do I call them back and what do I say to them? I don't want them calling me at work and I turned our phone off at home. Can I request to only be contacted throught the mail?

2) My husband and I are going to consolidate and did credit checks. All but one of my accounts say charge off. At this time, I am only going to include the one account that is still opened. Is this ok? And what if I get a pesky collection call for the charge-off accounts? What do I say to them?

Moonchild,

It is better to pay off all your debts so that improvement can be seen in your credit file. As your account has been sent to the collection agency, the negative remark has already been entered in your credit file. But you should pay it off so that you give a better view of your credit file to your future lenders. They will appreciate taking your responsibility and realize the fact that even though the account has been sent to a collection agency, you have made arrangements to pay it off.

Do your correspondences through mail and keep a follow up over the phone. Tell the collection agency that you don't want to receive any calls at your work and prefer to be contacted only by mail. Send a letter to them mentioning your point so that your approach towards them becomes legal.

Before making any payment arrangement, check the statute of limitation in your state. As your debt is charged off, it might be past the SOL period. Check the date of last activity of this account so that you get confirmed about its present status. You can't be forced to pay it after the expiry of the statute and legal actions also cannot be taken against you.

But if you make a payment agreement to the collection agency or make a payment towards this account, the SOL will be renewed from the beginning.

Do your correspondence with the collection agency in writing through certified mail. Request for a return receipt also. In this way, you will be sure about them receiving your letter and proving your side of the actions taken towards resolving this account.
