I received a citation saying I was being sued due to ill advised advice I chose not to respond hoping they would just pursue the other party involved but no avail they apparently set a court date that I had no notice of and default judgement was awarded. I need to know if I am now to late to react or is there a possibility to get the default judgement overturned? What kind of lawyer should I be looking for to help me in this case? Thanks in advance for your advice.


The reason I was being sued is because I stupidly helped a friend out by signing a sporting goods contract in which he needed two signatures for... I did not realize I was signing a personal gaurantee otherwise I would have not signed the paper. What really hurts here is that said friend is no where to be found so the have found me Default Judgement against me for the whole amount. I never got any benefit or even worked with this product but now I am looking at having to pay for it and their lawyers costs. urrrghhhh

I am sorry but you made a mistake by not reading the contract before signing it along with your friend. I guess your friend might have been aware of this paperwork but he hid this fact from you. Now, the company knows that you have acknowledged the agreement and since they are not able to find the person, they are considering you guilty here.

I guess, you should look for some attorney that can try to settle the matter outside the court with the party. If the matter is taken to the court, you will have a very rare chance of winning the case unless anything magical happens (if your friend appears at the court).

Your lawyer should try to make a deal with the sports good company and settle the matter completely. At the end, lesson learnt for all of us - 'never sign any paper with closed eyes.'
