Has anyone been contacted by them? Do they actually follow through with their threats? This debt is not mine and I've got the proof but I don't have the money to go to court even though I'm in the right. I was told by people to sit back, but now I'm worried that its going to come to court. Also does anyone know the legal term for these people collecting debt they know is not getting paid and expecting payment. There is one out there and I can't think of what it is, saw and article once and lost it....

Put a search on 'Zwicker and Associates' in this forum and you will find others sharing their experience with this company. They have been one of the tough collection agencies to deal with.

Since you have proof that this account does not belong to you, send a letter to them requesting to verify the account details. They must have proof of your name, SSN# and other specific details before placing the call to you. It is important that you send a letter through certified mail with return receipt requested. You need to have a copy that can prove your actions taken to resolve this matter. In case, the matter is taken to the court, the judge should see your defense clearly placed.

You won't be required to hire a lawyer if you have all the paperwork with you and prove that you do not owe them anything. Keep a follow up with Zwicker and Associates over the phone.

I have the divorce decree but they have my soc # and everything so somehow it got placed with the account either by their research or my ex husband forging my information to get me on the account without me knowing (my biggest fear because I still don't know how to prove forgery if thats the case). I will call them tomorrow and have them send me this validation information and then move on form there.
