I am being sued by these people. I received a letter saying that the plantiff has won a judgement against me and this is my last chance to make payment arrangements or they will enforce judgement and make me go before a judge to garnish my wages and\or my bank account. This is a very old credit card bill. Can they do this? Where can I go for help? Thanks for any help.


Those companies who actually take legal actions have a different approach altogether. They do not say anything loudly or give you any chance before taking the matter to the court. If they are decided, they will do it.

In your case, the company is using a scare tactic to make you pay the debt. They sound like one of those who can never take the matter to the court. If you check your local AG's office, you might find several complaints against them.

Remember, during judgments, the company has to file charges against you in the court. A notice will come to you 20 days before you are asked to appear in the court. If nothing like this happens, you are under no legal surveillance. This company is just using a common way to threaten you and see if they can make any easy money from you.

Ask the company to validate your debt. It is your legal right to know the details of the debt before you make any payment agreement. Send a debt validation letter requesting for the complete details of the accounts. Make sure that know the SOL period of this account. If it is past the statutes calculated from the date of last payment, you can legally refuse to pay it. Paying off the debt will improve your credit. I would have waited for a decent collection agency to contact me for this account. Looking at this stage, my credit is already tarnished by their remark and they can't spoil it any further.

Send your letter through certified mail with return receipt requested. You will be sure of your letter reaching them and it will be turn of the company to reply back. They can't take any legal actions until the debt has been validated.
