I would like to know what can i do i just recently recieved a summons stating the credigy is suing me over a debt that owe back in 98 and that they been sending me mail trying to collect on the debt that i owe but never recieved or heard from them until now that i go tthe summons. So what can i do to aboid this matter because i know i owe the debt but ive recently been trying to find out how to go about making payment arrangement so i can pay it off but now this scares me because i don;t know what to do canyou please help me with some advice, can they do that?

In your last post, you didn't mention the age of this debt. I suggested you to talk to your original creditor and make payment arrangements with them.

After knowing the time period of this account, I will suggest you to give a thought before you make a payment agreement. Since you said that the debt occurred in the year 1998, check the date of last activity in this account. It might be possible that the debt has gone out of the statutes period in your state if you have not paid anything recently. As per the laws in your state, you can verify if it is under the legal collection period or not.

Also, the federal laws state mention that the negative information will be removed from the file after 7 years. Since this account is past the time period stated in the FCRA laws, it should not appear in your credit file. Anyone viewing your credit file now should not get the details of this debt. If it has not been removed from your file yet, dispute with the bureau highlighting this item. If you make a payment, the debt will come in the legal collection period and also will mark its stay in your file for the next set of years.
