I am looking for input or suggetions on this 2nd letter to Sonic. All advise will be appreciated. I will be sending this letter on Monday. This will be the 2nd attempt at sending to Sonic. They refused the first one.

Dear Sonic Payday:

I am writing in response to the complaint I filed against Sonic Payday with the Office of the Attorney General in Tennessee, the Office of the Attorney General in Pennsylvania, The Federal Trade Commission, and the Better Business Bureau in Pennsylvania. Sonic Payday has failed to respond to the complaints with the Attorney General Office in Tennessee and Pennsylvania, and I have documented proof that you are not licensed in the state of Tennessee to conduct business. You did respond to the complaint with the Better Business Bureau agreeing to a payment plan. You are asking for a different amount than what is owed. The amount owed is $1258.00 and you have received 3 payments in the amount of $65.00 each.

I have forwarded documented proof of conversations with Erin Kennedy where she stated that the loan would be forgiven do to the Identity theft in July 2005 to the Attorney General in Tennessee and Pennsylvania and to the Federal Trade Commission and to the Canadian Authorities for the mistreatment received from Erin Kennedy.

According to the payday loan laws in the state of Tennessee, you have to be licensed in the state in which the borrower resides, and can only loan up to $500.00. You have loaned above the allowed amount. I have brought this to the attention of our Commerce Department, Attorney General and Consumer Protection.

Do to having this taped and documented forgiveness of the loan given by Erin Kennedy, and to the laws of Tennessee being violated by Sonic Payday, I am at this time requesting the loan be forgiven and all negative information be removed immediately. You have until March 27, 2006 to respond to this email. If this cannot be done in the time requested, I will be seeking legal action against Sonic Payday. My email address is.

DOCUMENTED CONVERSATIONS WITH SONIC

Sent proof of ID Theft by email, fax and certified mail on August 1, 2005, August 23, 2005, September 14, 2005

Sonic payday only accpepts western union according to Amber Moore on august 1, 2005. Refused to give address to send payments by certified mail.

Amber Moore left threat of arrest and wage garnishment on home answering machine on august 10, 2005. Tape turned over to sheriffs department for violation of fair debt collections act.

August 22, 2005 conversation tape recorded with Mr. Herrins permission that do to the id theft, fax another copy of theft report and debt would be forgivin.

September 13, 2005 received email from Joel Beggs that after attempted contact with no success had no choice but to forward to third party collection agency. Left several messages with Joel Beggs and he never returns the messages.

September 19, 2005 receive email from national capitol collections that account has been turned over due to failure to communicate with sonic payday. Talked to Michelle at 10:27 am and she stated that she wouldn't talk to spouse and didn't care what proof we have.


September 21, 2005 spoke with Mr. Andrews and he stated that they had documented in their system that they could speak with wife and Mr. Andrews transferred me to the collections department.

September 21, 2005 left message for Erin Kennedy that I had filed complaints against sonic with attorney general in Tennessee and Pennsylvania and Delaware and to please contact me to clear up this matter.

September 27, 2005 Erin Kennedy returned phone call and stated she was calling from Delaware. Erin stated that she received the fax of the police report and the loan will be forgiven.

September 29, 2005 Erin called once again and stated that we sent her a fraudulant police report and the loan will not be forgiven. I stated to her that it was an actual police report and would she like the officer who took the report to contact her and she stated no that it wasn't a real report. She stated we had to make arrangements immediately and when I tried she said it was unacceptable and the account was going to collections in January.

Sonic has given me addresses to send payments and when they were investigated and informed from the united states postal service that all united states addresses were forwarding addresses, I requested an actual address and I was givin one in British Columbia. According to our attorney general, I do not have to send money out of the country to make payments.


Sonic has been a difficult company to deal with. Please remember to keep your ground with them, and be persistant, as they have a hard time returning phone calls.

Talking about legal action gets them frustrated, so keep at it.

This is an easy company to repay as well, as they're more likely to remove any interest if you're willing to repay at a reasonable time.

I just realized something - when I spoke to them about repayment options, I asked the woman where they were located, and she said very vaguely, "out west"...then when giving me the Western Union info, she said, "Just leave the city and state part blank"...I was so stressed by my situation that it didn't even occur to me that their location is so shady.

Sonic is a very hard company to deal with. They started calling me on the day my father-in-law died. I tried to explain this situation to them to see if I could call them in a few days, when my mind was more clear. Of course not! I didn't pay them via western union but I almost did. Once I started thinking about things, it didn't feel right to me. I had heard the horror stories about Sonic. My situation also turned into a horror story with Sonic but they forgave my debt last month because they knew I had legal grounds to sue them. I was very persistent with them and would not give up.

Not to take their side, but you posted the letter on the 24th, then said on the 25th the letter WILL BE certified mail and faxed (i.e Not sent yet), but you gave them only until the 27th (tomorrow, Monday) to respond. You should always allow at least 10 business days for them to respond.

You may run into a legal problem, by not allowing them enough time to respond (in know what you thinking, but the issue at hand will be THIS letter). They will argue they need more time to review the case, and you simply did not give them enough time (once again, I know what your thinking). You are entering the Corporate level here, and things take longer the higher you get (you know have to wait for people to come back from vacations, the golf course, etc).

I mailed, faxed and emailed my letter to Sonic. Yesterday, my grandmother called me saying that someone with a foreign accent started calling them at 6:30 am demanding to speak with me or my hubby. They told them that if they don't speak to us by noon yesterday, that they would arrest us. My grandparents are in their 80's, both have heart conditions and don't need this crap. I told her that if they called there again to get a name, document what time they called and where they were calling from. I told her it was illegal for a collector to call before 8am and after 9pm. My grandparents are old fashioned when it comes to debt and they are worried sick that we are going to be arrested. What steps can I take to get this to stop. I think it is awlful funny that I fax and email the letter and they get a call yesterday with a threat. I want these people shut down.

Where did you take out the loan, in IL or in TN? Have you ever used their number in any application form? Are you sure that Sonic is calling your grandparents?

Ask your grandparents to visit this forum. I know an elderly lady who visits this site regularly to get some support and she also posts good information on this board. Hope your grandparents will get some mental support here. We will be glad to welcome them.

Did you ever live at the house that your grandparents live in now? If so, it's probably listed on your credit report and all they had to do was look up the phone number connected to that house and give them a call. I think it's called skip-tracing. collection agencies do it all the time. That's one of many reasons that I am in the process of having ALL old addresses removed from my credit report.

Stanley, Loan was taken out last year here in TN and we never ever give their phone number or address for anything. They do not believe in the internet or computers. They are very old school. Like I said in my earlier post, she stated it was a person with a forgein accent and it seems funny that I fax and email to Sonic and they get a call yesterday threatening to have us arrested.

Mary, I lived with my grandparents when I was 16 and their address has never been on the credit reports. I have had all previous addresses removed from the report and only our current address is on the report.
