I had taken a payday loan out in december 2005 for $250 and they have been debiting my savings account until I just stopped payment on it last week,now they called me today saying they were going to file fraud charges against me and get this they said do you no MARTHA STEWART I said yes and they said you are going to prison just like her,they also said she is a celebrity and she did'nt get off,what is so funny she did'nt have apayday loan.They have taken $150 each month since dec.2005,I believe they are already paid,Do I need to worry?


no. Check and see if your state requires payday loan companies to be registered or licensed (in your state's code it may be called, "payday loan act", "small loan act", or "deferred presentment"). There may also be limits on the amount of interest they can charge, as a total amount, usually around 15% of the amount borrowed. If these guys have already violated your state's statutes, file suit against them preemptively under your state's small claims procedure. Btw, if they say they're exempt from your state's laws because they're "international", just say, "that's fine, just give me your mailing address where you want to receive service of process" and get service on them under your state's procedure for service on nonresident defendants. Then start calling them and demanding that they pay off on the judgment.

If they have taken $150.00 out of your account for the last 3 months - then you should be paid off. They are trying to use scare tactics out on you to get more money out of you - they stand no ground. You should get documentation from them and make sure you have records of the payments made.

Be sure to read the loan documents. Some payday loan companies will take out the renewal fees (which would be anywhere from $25-$100) until you pay back the amount of the loan IN FULL. What payday lender did you deal with? Sometimes what you think is paying back on the loan, is actually a renewal fee.

Stanley: I'd looked at that table once before, and I never rely on compilations such as that. The law can change pretty quickly, and I find it's easier to go directly to the code and find what I need.

Surf: If you tell me what state and county you're in I may be able to do a little online research that will help you. Also, I need the full legal name of the company that's causing you problems, or if you're not sure about that, give me all the names you know of that they go by.
