Two Questions:

1 - Once an attorney's office has contacted you re-seeking a judgement does it help to inform them you are seeking an attorney for bankrptcy? They are different from collection agencies right?

2 - For bankrptcy it stays on your record 10 years. How long does a judgement stay? I am trying to figure out the difference between a judgement & filing bankruptcy.

Thank you!

My views:

When your creditor files lawsuit against you, the judge reviews the case and issues a judgment. Now if the plaintiff, i.e. the creditor wins, judgment enters your report. It is listed in the public record section and stays in your report for 7 years from the date of entry or as long as the SOL is live.

Bankruptcy is a different thing. By filing bankruptcy you declare that you are unable to pay your debts. So your creditors might be paid off by selling your property or the bankruptcy court might ask you to submit a payment plan. There are different types of bankruptcy. Bankruptcy is also listed in the public record section of the credit report and stays there for 10 years.

I have spoken to a couple of attorneys regarding bankruptcy and the cheapest that I have found is $700 and in our very brief conversation he seemed to be nice. Of course, he needs his money before he can do anything and I don't have it - so I am trying to figure that part of it out.

So in this case it is a letter regarding seeking a judgement against me (future tense.)

I have written a letter explaining my situation but if they get a judgement against me and then I come up with the money and file for bankruptcy what happens to the judgement?

Thank you -
