LCS the CA for Macy's is stating that I can not make any payments on my account, the bank will not let them take payments. When I stated I could not pay the account off today or settle the account today, the women I was speaking with became rude and said, then get your self an attorney. What does this mean. I am new to this and Im not sure how to handle this situation.

hi stanley. above you stated that a CA must respond to your VL prior to start collection, though on other posts i've read they can even send a summons (which i presume is a form of collection) without a VL, or they can present the VL in court. can you explain please? thanks for your help.

Hi guest2--I believe I was the one that posted what you're referring to. Not that Stanley can't still put his input here (very smart guy--that stanley! :D )
I was stating that **in some cases**, although it doesn't happen every day, you may run into a smart @ss collection agency, that when you ask for validation, you get a summons at your front door--its their way of saying--you want validation, is this validation enough for you? and then they would have to present the validation to the judge once you prove to the judge that you asked for validation and didn't receive it. At that point, if collection agency doesn't have validation, its definitely in your favor.

They are not supposed to do this. They can only take you to court if you do not respond to their validation. Now, if they send you summon without sending validation, chances are it will go in your favor as Shirley said.

You must send your request for validation through certified mail; a verbal request won't work in court. Once you get the green card back, you have enough clues against them.
