I am in official payday loan default

Well, on Friday I officially defaulted on all of my payday loans. The debits did not go through because I changed my account information. Actually ONE did go through after I faxed, mailed and e-mailed the company a letter unauthorizing them to debit my account. Luckily for me, they responded to the request via e-mail and fax threatening to bring charges against me. So I took that information to the bank and filed penalty of perjury complaints against the company. Now I just have to wait for the bank to put my money back into the account. Anybody ever gone through this process? I need to know how long it will take for the bank to put the money back. I know that the other companies will continue to try to debit my old account, just praying no more debits sneak through.


I will. I suspect it will take about a week. Now I'm praying that no other debits sneak through. I am so tired of walking around with this knot in my stomach and not being able to enjoy myself or concentrate on anything other than debt. Unfortunately, I have fallen behind on other (more important) bills and I must get them caught up also. I will be okay in about 6 weeks as far as being caught up but until then I guess I'll just have to grin and bear it. I sent in my payment to T&C this Friday and they told me they would be sending payments out to the creditors on Monday so hopefully this will go well. Has anyone dealt with cashnet500 or ICS? Just from reading about how they are here in the forums, I am afraid to go to work tommorow because I just know they will call my job and talk to my boss.

I never had a problem with ICS. I always thought their bark was much worse than their bite. they harrass me at home with constant phone calls and when the answering machine is on they leave unintelligible messages, but they have never called my work and have never threatened me whith legal action..And I have been sending them very small payments. I really think they're running out of steam fast- and anyway, it took a lot longer than 3 days for them to find out their payment bounced. You'll get a surprisingly polite email from heathmill before they ever try to contact you by phone. Their other company, Interim cash, has been much much more difficult, but even they never called my work or threatened me too much. Most of these people will call you at home 200 times a day before they get around to calling your work.

No, I did all of my stuff on my own. Looking back, sometimes I wish I had gone through T&C, but I had 5 loans, they were all less than $250 except for one, and I caught a few breaks. I changed my bank account info the first week of February, found this site, and got right to work. Now, 2 months later, things are really going well, just like they will be for you. I got your back!

I too defaulted on payday loans. I had 6. I paid one off this week and will continue to battle one who I feel has been repaid. The others called work once, but stopped at my request. I have been with T&C for a month and the past weekend I have received NO calls at all. It has been a VERY long time coming. I have been playing ostrich for over 2 years.

With ICS... they may complain but as long as they get the payments you promise they will generally go along. They will try and ask you for more, nut stick to your guns and promise only what you can afford. I would only send them once a month, since they will have you mail it to a delaware address that is a mail drop, which then forwards to england. (takes about 2 weeks. They will usually ask you to fax a copy of the money order as proof you have mailed it. If you have nmore questions, pm me and I will share what I know

Good luck to you i love teaching. I too defaulted on my payday loans Friday... though so far no one seems to know except PayDay Ok. I had 6 until pollyandsay scared one of them off for me (yes-she is my hero!). I will just take it as it comes but truthfully, not going further in debt this payday has made me feel better than I knew it would-even if I do worry about about fallout from it all. You can only do what you can do and I simply couldn't do it anymore. Take care and keep us posted!

One of my co-workers is being scamed by this company. I am the manager , and they called and were yelling at me today! I wouldn't give them any info, and contact your local authorities about them harassing you at work, because were I live it is illegal to harass someone at a business number.

I have had numerous payday loans and I have since paid back 4 and I have three more to go, I had someone get into my checking account and took $1950 and with the bounce check fees it was almost $4000. Arrowhead investments are trying to sue me and I have the bank statements showing them taking the money from my account. It was only a $200.00 loan. How can this go away and they are threatening having the police at my home and at my place of employment. I have trying to dig myself out of this mess and what I have paid back my checking account finally has some money and I am getting my bills paid but when a company stills says you owe them money when they have already taken it from you that has got to stop. What can I do? Any Suggestions?

Tell them to tell you what time the cops are going to show up so that you can have your bank statements ready to show them, and then you'll send the cops over to their house for their turn..lol

They can't have you arrested for that. They're lying to you.

Tell them to leave you alone or you'll file a complaint with your state attorney general's office for overcharging your interest...And if they come back for more, FILE the complaint. There's nothing they can do to you.

That's correct. Being default on a loan is not a criminal offense. Writing bad check could give one some trouble, but post dated checks are never counted as bad check. So relax, you won't see police at your door.

Most of the payday loan companies break the usury laws of states. Are they internet lenders or store front lenders. Do you know if they are licensed to do business in your state or not?

If you haven't already, think about closing your checking account and re-opening another. They will continue to debit your account otherwise. Then contact them..Be firm, don't let them scare you...And make some arrangements with them. Or, if you want to consolidate, register and someone will pm you info

Have you filed a police report regarding the theft of the $1950 from your account? This should be your number one priority, filing the report. After obtaining a copy, send that over to your branch manager at your financial institution, as well as filing a complaint there.

Upon the end of their investigation, your money will be returned to you along with a new account number. Waiting any longer than a days, since you first realized the theft, will make the report look fishy.

Also, regarding Arrowhead Investments, send them a cease and desist letter along with a copy of the police report. This will show that there was fraudulent activity on your account.

You might also want to call the place where you first took out the loan, and explain the story to them. Tell them you have everything documented.

When all the money is placed back into your account, you will have your payroll check to pay back the loan.

hello I declared bankruptcy because I fell behind with all my bills trying to repay the payday loans. Now one of the loan companies have threatened to have me arrested for bank fraud and bank by diception. I gave them my bankruptcy case # and the attorneys phone # but they said they were still going to charge me. Does anyone know if this can happen while in bankruptcy?

PL, If you filed chapter 7 payday loans are discharged. They will threaten you with everything. Dont fall for it. You are under bankruptcy protection. If they call you more than three times total they will have to answer to the judge. Inform your attorney because they are not to have contact with you. Good Luck KYSIDE38

Chpt 13 is the same way, if the creditor doesn't file a claim by confirmation then once the Chpt 13 is completed they can never collect the debt, it no longer exist. The only debt you come out of a Chapter 13 owing would be federal studen loans.
Can anyone let me know what to expect from VC FUnding, XPRESS Cash/DMS Marketing, ASAP, and Cash Supply when I default on the loans tomorrow.Will they call my co-workers? Boss? I work for the state and I know my boss will not respond, they won't even be put through my boss, but co-workers always love good gossip. I'm waiting for T & C's contract to come in the mail to sign and send my payment to make the consolidation official, until then I need a heads up on how much stress I'll be dealing with. Most payday loan companies do not even know you defaulted until 5 days after. They cannot call your co workers due to the privacy act. I pulled that on one of them as they called and left a hateful message on a coworkers voicemail with the same last name as mine. THey never called me back once I contacted them and told them what they did and that I kept the message the co worker forwarded to me. Just monitor your calls at home and advise your boss that you have a legal issue and do not want to take any calls at work. Or contact them now before they know you defaulted and advise you are not allowed calls at work. They are not allowed to call you after you advise of this. PL

Does anyone have an address or fax number for this company. I have been trying to send them proof of my bankruptcy so they cease collection. I hear they are real nasty but so far I have only talked to them once.

I have gotten myself in so much trouble. I have been reading the terrible stores on how these pay day loans are a dept trap and they know it. My story is so like alot of them I read, but now I'm in dept and almost my whole paycheck is gone every two weeks and I don't know what to do. I keep making more loans to cover my dept and now I'm in really bad and need a bigger loan to cover them. Does anyone know what I should do? Will I go to jail if I close my account, loose my job, license anything else. I will be glad to pay them off but I can't like this HELP ME SOMEBODY

Eyvonne, what state are you in? Are these storefront or internet pdls? Who are the companies? And how long have you been paying on them? If that wasn't enough questions here are some more: Have you placed a stop debit on your account with them, or have you considered closing that account and opening a new one? That is the first step in taking back control of your finances and taking the control away from them.

I just defaulted on a loan today it was due and the funds didn't go though because of strange charges. At first they did then the bank took them out and this company was going to give me another loan so I can pay the fees on my other 6 loans this is getting crazy how can I solve this

I am going to be in default of two payday loans as of Friday the 4th of May. I am really scared I am going to go to jail or something like that. I just got in way over my head and I can't pay the fees anymore anyone know what happens in this situation?

How long did it take for T & C to work on your account once you gave them the intial fee? I will get the contract on Wednesday, and I plan on overnighting the documents and the payment first thing Thursday morning. I will default on my loans officialy on Friday morning. I have 7 loans, and live in Wisconsin.

Criminal action is prohibited in WI so you are not in any kind of legal trouble as far as criminal. I would contact the store fronts and try to make payment arrangements with them. They can take you to civil court to get the money owed to them so its best to go ahead and work with them..
As for the internet one, which company are you dealing with??

The internet one is cashnet usa. I owe them about 300.00$ I already closed my checking account so that they can't debit and rack up nsf's for me.I really can't afford anything should I just senmd out some 10 and 20$ checks. I am just so worried. So if they take me to civil court do the cops come at all to my house or job or anything or do they just mail out the notice or what. I can't believe I did this to myself!!!! They wont take checks once you default plus if they get your checking info for the new account they will just go into that account and take it all...Send them mo, whatever you can afford monthly...they wont be too happy but they wont be complete buttheads either

I have defaluted on 5 payday loans that I have out right now does any one know what will happen? I can't afford to pay more than ten dollars a month to each company my hours have been cut at work. I am just wondering what is going to happen to me? Two are storefront and 3 are online.

What state are you in? You will need to contact the storefronts and work out a repayment plan you can afford. As for the internet pdls...which companies are you dealing with? You will need to close your account and open a new one, at a new bank if you can. These ipdls are sneaky bast@rds. And they will make illegal threats that are FALSE such as: they are filing fraud charges against you, you are going to be arrested, check fraud, the list goes on. Just get some thick skin and know that they are lying and these things will not happen to you, it is their inhumane way of trying to extort money from you. Also, how much have you been paying on the internet payday loans? You will need to file a complaint with your state's Attorney General's office against them and file one with the AG's office where the ipdls are located.
