Settlement with lawsuit
Date: Mon, 04/03/2006 - 07:36
I have been sued in 'small claims' court (in Pennsylvania) for an outstanding credit card debt ($5200.00). Although I have an attorney, I am wondering what to expect at the time.
We are hoping the attorney, who has a 200 mile drive, won't show up, but most likely someone local will be there on his behalf.
I have been classified as 'judgement proof', meaning I have no property or assets to overtake. I do own my vehicle, however, and since I need to use it to travel to/from work that is an issue.
Even if a lower settlement amount is negotitated, I cannot make any lump sum payment, in whole or in part, so my best offer will be a monthly payment of around 100-150.
If anyone else has been through this, please let me know your outcome.

Being judgment proof might help you get your payment arrangement
Being judgment proof might help you get your payment arrangement approved. It also depends on your income, other financial obligations and the SOL of the account also.
BTW, have you tried to clear this account in past?
Good Luck. Your attroney should be able to get you in good stead
