I need some advice. I got behind with Bank of America a while back because they weren't sending me a paper bill (my option) and I couldn't get online to see my bill. I only missed a payment or two at best and it was a long time ago. I pay them $80 a month for about a year now, but all of a sudden they are sending me letters threatening me with collections or a lawsuit. I took a look at the bill and they want a 1600 dollar minimum payment. So I send them a letter asking them to renogiate because I can't pay that amount. They never answered me and sent me another letter today.

The odd thing is they send these letters weeks after I'm supposed to respond to them. This one, received April 8, 2006, says to call them by March 20, 2006. The last one was similar, and they both said I have refused to contact them.

My point is why are they doing this when I am paying them every month and why are they saying I'm not contacting them? HELP :cry: :cry:


what kind of account?? I have found dealing with the front line people when you need special assistance is less than productive, but if you keep climbing the ladder, the higher up you get the more likely you are to find someone more willing to listen and do some research.
If you only missed one or two payment, that doesn't explain the dramatic increase in the minimum (other than the new federal law which went into effect at the beginning of the year requiring them to raise the minimum down payment to so more of the principal is being paid off.

Dispute the amount they are requesting ( you have a limited amount of time to do this) , and ask them to account for how they arrived at that number. Past experience has told me they are willing to recall account from collections and attorneys if you are willing to work with them to resolve the problem.

It's a credit card account. I don't know how they got at the figure they are requesting. I have been paying them $80 a month and that apparently isn't making a difference. Maybe I didn't send the letter to the right place. It's been 3 weeks and I've heard nothing.

Is $80 the minimum? Did you look at your statements each month, or just have the payment set on auto pay? You have aright to ask them to explain how they computer the payment they request, and how they arrive a the balance. These requests should not go tot the same address as the payment, on the back of the statement there should be a correspondence request.
I found with them if you show your are sincere,and want to get the situation resolved, they are more willing to work with you . Like I said calling and talking to the front line people doesn't help, you need to write them, and get to some people with more ability to look into
the situation and do a little research for you.

I did do auto-pay, which is probably a lot of the problem. I will write them another letter with the address on the back of the statement. Didn't even think of that.

If you had it on auto pay but kept using the card, that is probably where you went off track. As you use the card the minimum payment continues to increase. if you kept making only $80 then you probably weren't making full payments at some point. Also keep in mind that the minimum payment is mostly interest charges, only 2 to 5% actually goes to pay down the balance.

I am dealing with a Collection Agency. I have been paying off on a monthly basis an old credit card account for the past 9 months @ $75.00.

I receive an alert from my bank that a autopay from them was posted for the full amt of the debt. $900.00 I called her & was very rude. Thank god it wasnt She said we had spoken and I authorized this amount, I have no paperwork,fax or any documents. thank god it was my mortgage pyt. Does the Agency have the authorization to change the amount of the authorized amount?

what does validation have to do with anything? the person made arrangements, which is tantamount to admission of the debt. DV is not the be-all-end-all solution its made out to be here.

on what authorization are they claiming? verbal? is there a conversation you can recall that might have given them that impression?

Guest, DV has everything to do with it!!! She should never have agrees to pay a dime until the debt was validated! How does she know that the CA owns the debt and has the right to collect it? It makes no difference if she "made arrangements" she can always change her mind about the arrangements if they are robbing her blind!!! You appear to be a lowlife Collector, so why don't you scoot back under your rock!!!
