Need some advice please?

Hi folks, I know this is a familiar story but here is my situation. I owe on PDL and a personal loan thru American General. I am signed up with T&C and they are still in the process of finalizing proposals with everyone. Problem is today I rec'd a call from Advance til Payday today and boy, they are not being very nice. The message they left on my voicemail said they do not work with debt management companies and I need to have T&C stop contacting them. They said if I don't contact them and set up some sort of arrangements with them they will proceed with legal action that could include leins,garnishment, and court costs. I sent an email to T&C asking for advice but thought I would throw this out to you all and see what you suggest. Thanks for your help.


American General is bluffing. They can and will work with T and C, and just so you know, litigating debts is not worth doing unless the debt is at least five figures. Also, since you have T and C on your side, that's enough evidence of intent for the judge to throw it out of court should they ever pursue that avenue.

Don't listen to those lying apes. Stick with T and C. They're your new best friends.

Sue,I live in Washington State. I pulled my copy of the loan agreement and I just noticed they do not even have their name on it anywhere,just the street address and phone number. Weird huh? What is the best way to find out if they are licensed with the state? I want to get as much information as I can just in case I end up having to talk with them. Also, I just saw in the agreement the part that says I willnot put a "stop check" on the check I wrote. Well, I did. How much trouble can I get in for that?

I don't know the Washington state laws but if you look on the division of banking for your state you may find them there. Pollyandsay is wonderful about helping others find their states information and writing letters. What company is it? If it's one I have I may be able to give you some insight.

Jedi Mistress, Thanks for the info about American General.Last time I spoke with them they said they might work with T&C but they would expect me to pay $300 at least to them first as I am behind on payments. I'm hoping T&C will take care of everything. I can't afford that $300 on top of the fee to T&C. I had to borrow money from my landlord on Thursday to take my cat to the vet and then ended up having to put him to sleep. I'm still very emotionally messed up over that but I will be happy again, I think.

Don't give those loansharks jack! They just want that so they can continue manipulating you and continue souping up their dink-lengthening cars. They don't give a rats hat about negotiating with you! All they care about is what they can take. F them! The whole thing is in T and C's hands and that is the end of it! Don't listen to those pieces of shit!

I just discovered this site today and it is good to hear comments from people in the same situation as me. I currently have several payday loans because my credit sucks but am trapped now as the rollover/extension fees are more than $1900/mth which is now more than my take home pay after my rent is paid. I have no idea what to do. ANY advice would be helpful. It's weird that there isn't a niche out there for people like me as I could afford to pay $800/mth comfortably to a bank or loan company if they would loan me $5000 to pay off my current payday loans.

I am so sorry to hear about your cat.
:( I had to put one of mine down a couple of years ago and I know it is hard to do I now have one left and he's my baby. I also have a loan with AMERICAN GENERAL :evil: and they do work with T&C. They (AMG) told me I had to pay $300 too before they go with debt management. But I got T&C involved and had them call my local office of American General and talk to the manager. He agreed with AM General's proposal - and what T&C did is to make a payment at the AM General office in Birmingham that week so it would be credited (and wouldn't go to collections) to my account and they only paid $150 which is the monthly payment T&C is paying AM General and that was the payment I was paying to AM General. If I was you find out who the manager is of your local AM General or the office you have the loan with and have T&C call them and speak with the manager. T&C was very agressive with AM General and finally got them off my back and no more phone calls from them!!! SO your AMerican General office is bluffing like mine did. Get T& C involved with your local American Gerneral's office.

Keep on it, and eventually they will have to accept.
I'm sorry about your kitty, I know how emotionally draining it is. They are a part of your family, and it is a great loss.
Everything will work out fine with T&C, from what everyone here says, they're pretty aggressive with these guys.

Hi,

I came out here to see if anyone has dealt with American General. I also have a loan with them for $1500 I beleive $500 is interest.. I got behind two months and they started calling my references.. came to my home and left a card with the person that answered the door.. and then when i tried to talk to him on a Monday and gave them a post dated check for that friday 5 days away he said no they could not take it that i must borrow the money from somoene that they HAVE to have it in their office by the next day post dated for wed. I told him I was not paid until Friday so he made it sound like the way they would handle it would be to deposit it the day before so it would clear. Offcourse it didn't clear because it went in early. Now I have bounced fees to the bank and them and am now 3 months behind. They call my home, cell, and work every day and every so often my references. I see that some of you have gone through T&C I am going to call them this weekend to try and set up a plan. In the mean time what is the worst that American General can do to me?? I guess it would be collections right?? Since they showed up at my home I am afraid they will show up at my work. They do not work with me at all on the phone so their is no point in my talking to them until i have the money or T&C to help me. It was a secured loan.. they used my computer.. tv etc.. which isn't really worth all that much.. will they come take that stuff?? Any advice is much appreciated. Thank you

If it is a secured loan, they can take the things you used as collateral. You need to talk to T&C as soon as possible to find out from them how long it will take before Amercian General starts to get their money if you sign up for their program. Also, take a close look at your contract with AmGeneral to find out the specifics of the collateral. Kind of like with a title loan on a car, they really don't want to take your stuff and will try every other way to get their money. I had a title loan once, defaulted on it, and forgot to include them in my bankruptcy filing. When my car broke down, I had it sitting in my parking space at my apartment complex. When I moved, I had the car towed to the parking lot of the title loan place and told them to deal with their car. They held the title to it, legally, so they had to figure out what to do with it. LOL!
